Regular Council STAFF MEMO Meeting: Regular Council - Jun 10 2021 Staff Contact: Jeremy Allen, Village Manager Department: Parks and Rec Authorize Change Order No. 1 in the amount of $160,711.35 with Hedrick Brothers Construction in connection with construction of the new Community Center. SUMMARY: On February 11, 2021, the Village entered into a contract for Construction Manager at Risk services with Hedrick Brothers Construction in the amount of $6,013,394.00 to construct the new community center. The attached proposed change order arose due to changes in the scope of the project in addition to changes in the cost of construction materials brought on primarily by supply chain issues due to COVID-19 as well as weather -related delays caused by the recent winter storms in the Gulf Coast region. As a result, a number of our manufacturing partners are invoking force majeure as a reason for increases in their prices. These circumstances, combined with delays in rail transportation of raw materials, have placed a tremendous strain on the various supply chain networks. Manufacturers are also contending that, while they hope to see some stability in costs in the future, they are not certain of future price increases which may necessitate further adjustments. Hedrick Brothers has also indicated that, as a result of the aforementioned time delay (approximately 51 days), it has incurred additional costs of $59,462.94 which it must pass on to the Village. This cost is included in the total change order amount of $160,711.35 mentioned previously. The proposed change order was reviewed and approved by the Village's architect of record, REG Architects, pursuant to the contract's terms and conditions. This cost increase can be absorbed with remaining loan proceeds. If a component The Experts supplies within the system is defective in normal use due to a fault of the product(s) and/or materials, The Experts will at its discretion replace the defective item under it manufacturer's warranty for a period of 90 days from the date of substantial completion. Substantial completion is defined here as the point in time when your equipment has been delivered and installed. Warranty after 90 Days: Many components in your system will have manufacturer's warranties that extend past the 90 day terms of this plan. If an item(s) becomes defective after the 90 day term is up The Experts will remove, submit for repair, and reinstall this equipment for you at our standard service rate. Non -Payment: Payments not received within 7 days of invoice is subject to interest of 18% Credit Card Payments: The Experts would be glade to take your Credit Card payment, however credit card payments are subject to a 3% surcharge. Deposits, Balances, and scheduling your project: Deposit: Before your project can be added to The Experts work schedule, a deposit consisting of all equipment, Misc. Parts, and Sales Tax must be received by our office.
