HomeMy WebLinkAboutDocumentation_Local Planning Agency_Tab 00_6/17/2021 MINUTES LOCAL PLANNING AGENCY MEETING VILLAGE OF TEQUESTA, FL COUNCIL CHAMBERS (LIMITED MAY 10, 2021 5:30 PM SEATING) AND VIA YOUTUBE CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Janet Strand at 5:56 p.m. A roll call was taken by Community Development Planner, Lance Lilly. Present were: Board Chair, Janet Strand, Board Members Elizabeth Schauer, Ashley Warren, Leslee Dasher, and Theresa Maggio. Also present were Village Attorney, Amity Barnard and Community Development Director, Nilsa Zacarias. Absent was: Vice Chair Steven Eagen and Board Member Marguerite Wilson. 1. APPROVAL OF AGENDA MOTION: Member Schauer made a motion to approve the agenda. Member Maggio seconded the motion. Carried unanimously 5-0. 2. APPROVAL OF MINUTES MOTION: Member Maggio made a motion to approve the previous meeting minutes of April 15, 2021. Member Schauer seconded the motion. Carried unanimously 5-0. AGENDA ITEMS 3. ORDINANCE NO. 09-21: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE IX. SUPPLEMENTAL REGULATIONS. DIVISION 1. GENERALLY. TO CREATE AN ENTIRELY NEW SECTION 78--TE DOGS WITHIN CERTAIN OUTDOOR PORTIONS OF PUBLIC FOOD SERVICE ESTABLISHMENTS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-SECTION OF CHAPTER 78. ZONING. ARTICLE IX. DIVISION 1. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Board Chair Strand read Ordinance 09-21 into the record. Attorney Barnard explained the ordinance would create under limited circumstance the allowance for dogs outside of restaurants. The ordinance would add a purpose section, definition section, to the Village Code. Attorney Barnard explained that business owners would require a permit to allow for dogs to be outside their restaurants. The permit would have an insurance requirement, a fee and the applicant would need to provide a diagram/drawing indicating the allowable locations for dogs. Lastly, if necessary the policedepartmentas well as code enforcement can enforce the dog regulation. Board Member Dasher questioned what reasonable control meant in the ordinance. Attorney Barnard answered that the ordinance states the dog must be on a leash. MOTION: Member Warren made a motion to recommend approval of Ordinance 09-21. Dasher seconded the motion. Carried unanimously 5-0. STAFF COMMENTS Community Development Director Zacarias thanked the Board for their attendance. PUBLIC COMMENTS There were no Public comments. BOARD COMMENTS There were no Board comments. ADJOURNMENT MOTION: Schauer made a motion to adjourn at 6:04 pm. Dasher seconded the motion. Carried unanimously 5-0. PUBLIC NOTICE VILLAGE OF TEQUESTA LOCAL PLANNING AGENCY MEETING The Planning and Zoning Board of the Village of Tequesta sitting as the Local Planning Agency will conduct a Public Hearing on Thursday, June 17, 2021 at 5:30 p.m., or as soon thereafter as possible and continuing from time to time and place to place as necessary. The Local Planning Agency Meeting will be held in the Council Chambers with limited seating due to required social distancing per CDC guidelines. Residents will also be able to watch the meeting via the Village's YouTube Channel (https://bit.ly/VOTYoutube). If you wish to submit a comment to the Local Planning Agency, please use Citizen Comment Card (http://www.tequesta.org/forms.aspx?FID=192). The Local Planning Agency will make recommendations to the Village Council on the following ordinance(s): ORDINANCE NO. 11-21 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE XI. SIGNS. SEC. 78-742. EXEMPTIONS. TO REVISE REGULATIONS FOR SANDWICH BOARD PLACEMENT; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE; A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Related documents are available for inspection and copying by request to the Community Development Department via email at nzacarias@tequesta.org or by calling at (561) 768-0457. The Public Hearings may be continued from time to time, as necessary. All interested persons are encouraged to come to the Public Hearings and be heard. If a person decides to appeal any decision made by the Local Planning Agency with respect to any matter considered at such meetings or hearings, he or she will need to ensure that a verbatim record of the proceedings is made, which record should include the testimony and evidence from which the appeal is to be based.
