Box 3273 Tequesta, FL 33469-0273 SUBJECT: Outstanding Issues - Tequesta Village Center Dear Mr. Couzzo: In advance of the December 10, 2001 meeting between 41 °41"1 l3.'x s FFT IE:S'. ': (JMZ) and the Village of Tequesta, JMZ has prepared the attached agenda delineating the various outstanding issues relative to the development of the Tequesta Village Center. As illustrated on the agenda, there are seven main issues and associated sub - issues that need to be discussed and resolved in short order. REIMBURSEMENT FOR OUTSTANDING INVOICES • Reimbursement to JMZ in the amount of $36,000.00 for the VOT's share of the infrastructure utilities installation costs. ® Reimbursement to JMZ in the amount of $2,064.00 for the plantings and irrigation system installation within the right-of-way of Tequesta Drive. Reimbursement to JMZ in the amount of $3,058.00 for the preparation of the Tequesta Village Plat. • Reimbursement to JMZ in the amount of $1,987.50 for engineering seriic:e provided by Messler & Associates during the construction of Main Street. • Reimbursement to JMZ in the amount of $799.00 for legal services provided by Blackburn & Backus relative to the Reciprocal Parking Agreement. • Reimbursement to JMZ in the amount of $1,000.18 for revisions to the plat, recording fees and copies as requested by the VOT. Total Reimbursement Due To JMZ: $44,909.78 2. OUTSTANDING MAIN STREET ISSUES • Installation of street lights as per the approved Site Master Plan. • Installation of landscaping as per the approved Site Master Plan. Reimbursement to JMZ for the Main Street right-of-way arcs that currently encroach on the northwest parcel and the east parcel of Tequesta Village Center, as owned by JMZ. 3. BRIDGE ROAD ISSUES • Construction of the Bridge Road "streetscape" as committed to by the VOT. 4. PLAT ISSUES • Resolution of the discrepancy between the recorded plat and the recorded subdivision plan contained in the agreement between the VOT and JMZ. Page 2 of 2 6. RECIPROCAL PARKING EASEMENT AGREEMENT ISSUES • The removal of the "Tow Away" signs located on the adjacent Bank of America property owned by Mr. Allan Welles. • Resolution of the Reciprocal Parking Easement Agreement as applicable to the property owned by JMZ. 6. OTHER OUTSTANDING ISSUES • Vegetate the southwest and southeast parcels of the Tequesta Village Center as committed to by the VOT. Repair the existing asphalt cartway located on the east side of Tequesta Village Center as committed to by the VOT. 7. REPURCHASE OF THE SOUTHWEST PARCEL SY JMZ December 17, 2001 Mr. John Zuccarelli JMZ Properties 196 Tequesta Drive Tequesta, FL 33469 Dear John: Your letter dated December 9, 2001, was received by me on December 15, 2001. I have researched various Village of Tequesta records and cannot find documents which identify the Village of Tequesta's responsibility for many of the items noted. I would appreciate you providing me with any documents that might help clarify the responsibility for these items as noted in your letter. REIMBURSEMENT FOR OUTSTANDING INVOICES • Reimbursement to JMZ in the amount of $36,000.00 for the Village of Tequesta 's share of the infrastructure utilities installation costs — Please submit documents or identify page(s) in existing agreement which refers to same; also, identify specific improvements noted • Reimbursement to JMZ in the amount of $2, 064.00 for the plantings and irrigation system installation within the right-of-way of Tequesta Drive — Same as above • Reimbursement to JMZ in the amount of $3, 058.00 for the preparation of the Tequesta Village Plat — Same as above • Reimbursement to JMZ in the amount of $1,987.50 for engineering service provided by Messler & Associates during the construction of ,'plain Street — Please provide proof of payment of documents referencing services provided as well as any noted promissory documentation from Village of Tequesta. • Reimbursement to JMZ in the amount of $799.00 for legal services provided by Blackburn & Backus relative to the Reciprocal Parking Agreement — Please provide documents stating Village of Tequesta would assume legal expenses in JMZ's behalf. T1 • Reimbursement to JMZ in the amount of $1,000.18 for revisions to the plat, recording fees and copies as requested by the VOT — Costs normally borne by developer; please provide any documents stating it was agreed upon by Village of Tequesta to bear expenses. Total Reimbursement Due to JMZ: $44,909.78 REIMBURSEMENT FOR OUTSTANDING INVOICES • Installation of street lights as per the approved Site Master Plan — Working in same for Main Street • Installation of landscaping as per the approved Site Master Plan — Please provide documents showing the Village of Tequesta is responsible for landscaping outside of their ROW • Reimbursement to J111IZ for the Main Street right-of-way arcs that currently encroach on the northwest parcel and the east parcel of Tequesta Village Center, as owned by JMZ — Please explain; provide any back up documents BRIDGE ROAD ISSUES /'� • Construction of the Bridge Road "streetscape " as committed to by the Village of Tequesta — Ongoing PLAT ISSUES • Resolution of the discrepancy between the recorded plat and the recorded subdivision plan contained in the agreement between the Village of Tequesta and JMZ — Please provide additional information as to your understanding and reason(s) as to why you feel Village of Tequesta is responsible. RECIPROCAL PARKING EASEMENT AGREEMENT ISSUES • The removal of the "Tow Away" signs located on the adjacent Bank of America property owned by Mr. Allan Welles — Not Village of Tequesta property; this is a private issue between JMZ and the Bank of America. • Resolution of the Reciprocal Parking Easement Agreement as applicable to the property owned by JMZ — Again, not understanding the Village's interest in your outcome as well as the Village of Tequesta hopes that you can work this out with the adjacent property owner; this is a private issue JMZ must work out in order to comply with necessary parking. te,� OTHER OUTSTANDING ISSUES • Vegetate the southwest and southeast parcels of the Tequesta Village Center as committed to by the Village of Tequesta — Again, please see (2) above; provide noted information • Repair the existing asphalt cartway located on the east side of Tequesta Village Center as committed to by the Village of Tequesta — If this is our property, then the Village Manager would be looking into the cost and review the matter for approval through council. REPURCHASE OF THE SOUTHWEST PARCEL BY JMZ It is my understanding, in accordance with the contract between the Village of Tequesta and JMZ, we are under no obligation to sell the property to JMZ. However, as a result of your lawsuit and prior communication with the Village, it is apparently your desire to purchase the Southwest parcel from the Village of Tequesta. That is a decision to be made by the Village of Tequesta council. Your prompt receipt of the noted documents would be appreciated by January 2nd. I would like the Council and Village attorney to review same and consider your requests at our January I Oth Council meeting. Should you have any questions please do not hesitate to contact me.
