I. CALL TO ORDER AND ROLL CALL The Village Council of the Village of Tequesta held a Special Meeting at 250 Tequesta Drive, Suite 300, Tequesta, Florida, on Tuesday, November 6, 2001. The meeting was called to order at 5:03 p.m. by Vice -Mayor Joseph N. Capretta. Roll call was taken by Village Clerk Wolcott: PRESENT—Councilmember Russell J. von Frank, Vice Mayor Joseph N. Capretta, and Councilmember Basil E. Dalack. Mayor Geraldine A. Genco was in attendance via speaker phone. ABSENT—Councilmember Sharon D. Walker. ALSO 1N ATTENDANCE — Village Manager Michael R. Couzzo, Village Attorney John C. Randolph, Village Clerk Mary Wolcott. H. APPROVAL OF AGENDA MOTION: Councilmember Dalack moved to approve agenda, Councilmember von Frank seconded. Motion carried 4-0. III. NEW BUSINESS A. The attorney shall request an attorney/client session regarding JMZ Tequesta Properties, Inc. vs. Village of Tequesta, Case No. CA 01-11262 AJ. Fifteenth Judicial Circuit, Palm Beach County, Florida. Announcement of the time and names of the persons who will be attending the session. Village Attorney Randolph requested an attorney/client session regarding litigation to seek advice regarding the suit filed by JMZ on October 31, 2001, with a complaint for specific performance alleging the Village should sell back Parcel 1 to JMZ. Mr. Zuccarelli's attorney filed for Recycled Paper Page two Special Meeting November 6, 2001 emergency injunctive relief to prevent demolition. The judge denied his request to set a hearing for the reason no tender had been made for Parcel 1 by Mr. Zuccarelli. He requested the Council to give notice of date, time and place, and names of persons who will be in attendance. Village Attorney Randolph stated the meeting would be from 6:00 p.m. to 6:45 p.m. at 250 Tequesta Drive, Suite 300 on November 8, 2001. Those attending the session will be Village Manager Couzzo, Mayor Genco, Vice -Mayor Capretta, Councilmember Walker, Councilmember von Frank, Village Attorney Randolph, Attorney Peter Holton, and Certified Court Reporter Jane Pastore. MOTION: Councilmember Dalack moved to have the meeting in the time and place and manner as described by Village Attorney Randolph, seconded by Councilmember von Frank; motion carried 4-0. IV. ADJOURNMENT Meeting was adjourned at 5:1 5 p. m.
