RE; Future Land Use/Comprehensive Plan Amendment
(Referred to as the Zaino's property) — Small -Scale Amendment
Ms. Marilyn Zaino, owner of the subject property, is requesting a "Commercial" land use designation for a
site located at 801 U.S.Highway One North, Tequesta, FL 33469. The property was voluntarily annexed
into the Village. The site contains several lots that have been developed as one overall site. The site has
been used as a restaurant with the parcel fronting on U. S.Highway One (containing Lots l through 7)
having a current County land use designation of PBC, Commercial High (PBC. CH-5), and the rear two (2)
parcels (containing Lots 13 and 25) having a PBC land use designation of Medium Residential (PBC, MR-
5). The `Commercial" land use being requested pursuant to the Future Land Use element of the Village of
Tequesta Comprehensive Plan is consistent with the current use of the pamperty, and it will be of a sir i
land use and intensity as those adjacent uses on U. S.Highway One. The future land use request will require
a change to the Future Land Use (FLU) Map. Because this property was annexed into the Village, the FLU
Map will have to be amended to reflect the new "Commercial" designation. The entire FLU Map Series
consisting of the General Soils Map, Flood Zone Map, Coastal Zone and Conservation Map and Hurricane
Serge Map will have to be amended to reflect the municipal boundary changes as well.
The proposed Future Land Use request is consistent with the Goals, Objectives and Policies of the Village
of Tequesta Comprehensive Plan. The FLU/Comprehensive Plan amendment is a "small-scale"
amendment., It will be transmitted to the State Department of Community Affairs (DCA) and other
appropriate agencies for informational purposes, if approved.
It is recommended that the Village Council approve the proposed Future Land Use/Comprehensive Plan
amendment.

VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING THE COMPREHENSIVE PLAN OF
THE VILLAGE OF TEQUESTA, FLORIDA IN
ACCORDANCE WITH THE LOCAL GOVERNMENT
COMPREHENSIVE PLANNING AND LAND
DEVELOPMENT REGULATION ACT, AS AMENDED,
ADOPTING A SMALL SCALE DEVELOPMENT
AMENDMENT TO THE FUTURE LAND USE MAP IN THE
AREA DESIGNATED ON THE ATTACHED EXHIBIT,
APPLYING A COMMERCIAL LAND USE
CLASSIFICATION TO A PORTION OF REAL PROPERTY
LOCATED AT 801 U. S. HIGHWAY ONE, CONTAINING
APPROXIMATELY 0.66 ACRES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 163.3161 et seq., Florida Statutes, being the
Local Government Comprehensive Planning and Land Development Regulation
Act, the Village of Tequesta may adopt amendments to the Comprehensive Plan;
and
WHEREAS, pursuant to Section 163.3179, Florida Statutes, the Village may
make small scale development amendments pursuant to the provisions of said
statute; and
WHEREAS, the Local Planning Agency of the Village of Tequesta has held a
public hearing to make recommendation to the Village Council and has
recommended the adoption of the amendments to the Comprehensive Plan
contained herein, and
WHEREAS, the Village Council wishes to approve and adopt a small scale
amendment to the Land Use Map of the Village as set forth on Exhibit "A"
attached hereto.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:
Section 1. The Village Council of the Village of Tequesta, Florida, does hereby
amend the Comprehensive Plan of the Village in accordance with the Local
Government Comprehensive Planning and Land Development Regulation Act, as
amended, adopting a small scale amendment to the Future Land Use Map in the

area designated on the attached exhibit, applying a commercial land use
classification to a portion of real property located at 801 U. S. Highway One,
containing approximately 0.66 acres.
Section 2. Severability. If any provision of this Ordinance or the application
thereof is held invalid, such invalidity shall not affect the other provisions or
applications of this Ordinance, which can be given effect without the invalid
provisions or applications, and to this end, the provisions of this Ordinance, are
hereby declared severable.
Section 3. Repeal of Ordinances in Conflict. All other ordinances of the
Village of Tequesta, Florida, or parts thereof which conflict with this or any part
of this Ordinance are hereby repealed.
Section 4. Codification. This Ordinance shall be codified and made a part of
the official Code of Ordinances of the Village of Tequesta.
Section 5 Effective Date. This Ordinance shall take effect immediately upon
its passage and approval, as provided by law.

JUSTIFICATION STATEMENT
The Applicant annexed the subject property into the Village of Tequesta on Se
21, 1999. The discussions with the Village leading up to the annexation,r

Annexation and the Annexation Staff Report all contemplated a Commercia

Designation as well as a Community Commercial (C-2) Zoning District for the
property. The
commercial use is consistent with the property's frontage on U.S. Highway One, the ad'
commercial uses and the historical commercial use of the property for adjacent

Unfortunately, after the property's annexation into the Village, no action was taken
to assign a
Commercial Land Use or commercial zoning to the property. At this time the Applicant
