HomeMy WebLinkAboutOrdinance_14-21_10/14/2021ORDINANCE NO. 14-21 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 2. ADMINISTRATION, ARTICLE V. ELECTIONS, SECTIONS 2- 232, TO REVISE THE COMPOSITION OF THE VILLAGE'S CANVASSING BOARD, AT THE REQUEST OF THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS; FURTHER AMENDING THIS ARTICLE TO DELETE OBSOLETE TEXT; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 2. ADMINISTRATION SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, Chapter 2, Article V, Section 2-232 of the Village Code of Ordinances sets the composition of the Village's Canvassing Board as the Village Clerk, one Village Councilmember who is either unopposed or not running for office in the election, and the SOE; and WHEREAS, the Village Council, based upon a request from the SOE and the recommendation of the Village Clerk, desires to revise the composition of the Village's canvassing board as a uniform canvassing board established by Palm Beach County containing the SOE, one circuit court judge, and the Mayor or designee of Palm Beach County; and WHEREAS, The Palm Beach County Supervisor of Elections shall conduct the election, certify the accuracy of the tabulation equipment, and handle, canvass and certify all ballots, including absentee ballots; and designate the Village's Canvassing Board, and WHEREAS, the Village Council believes this amendment to its Code of Ordinances is in the best interests of the citizens of the Village of Tequesta. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: The foregoing facts and recitations contained in the preamble to this Ordinance are true and accurate and are hereby adopted and incorporated by reference as if fully set forth herein. Section 2: Chapter 2. Administration. of the Code of Ordinances of the Village of Tequesta is hereby amended at Article V. Elections. Division 1. Generally. at Sections 2-232 to revise the canvassing board composition to at the request of the Palm Beach County Supervisor of Elections; providing that Chapter 2, Article V, Division 1, Sections 2-232 shall hereafter read as follows: ARTICLE V. - ELECTIONS DIVISION 1. - GENERALLY Sec. 2-232. - Canvass and certification of elections. The Village Council delegates all canvassing duties, as defined by Florida Statute and the Florida. Administrative_ Code to the County Canvassing Board I nteicL by the Palm Beach County Commission and the Chief Judge of the Fifteenth Judicial Circuit and will be comprised of the Supervisor of Elections: a county court judge, who shall act as chair and the chair of the board of county commissioners. or their respective alternates or substitutes. Administration. shall remain in full force and effect as previously adopted. Section 4: All Ordinances or parts of Ordinances in conflict be and the same are hereby repealed. Section 5: Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. Section 6: Specific authority is hereby granted to codify this Ordinance. Section 7: This Ordinance shall take effect immediately upon adoption.
