RE: Violation of Chapter 14, Article II, Section 14-3 1, Chapter 14, Article 1, Section 14-6, and Chapter 78, Article VI, Section 78-143 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition). Address: 262 Golfview Dr. Tequesta, Florida 33469 Legal Description: TEQUESTA LT 281 PCN: 60-42-40-26-01-000-2810 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 91" day of November, 2021, and based on the evidence and testimony presented, enters an Order Assessing Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. The Respondent is the owner of the above -described property. 2. The Respondent was not present at the hearing; however, there was a finding of proper notice. Page 1 04'�, 3. By the "Order Finding Violation" dated September 20, 2021, the Special Magistrate ordered the Respondent to comply with Sections 14-31, 14-6, and 78-143 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition) on or before September 28, 2021. 4. Based upon the evidence, pictures and testimony presented at the hearing on November 9, 2021, the Special Magistrate found that the property remained in violation of Sections 14-31, 14-6, and 78-143 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition). CONCLUSIONS OF LAW The above -stated facts constitute a continuing violation of Sections 14-31, 14-6, and 78-143 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition) ORDER It is the Order of the Special Magistrate that a Fine of One Thousand, Fifty Dollars ($1,050.00) be assessed against the property, at Twenty -Five Dollars ($25.00) per day, for the violations which have existed on the property beginning from September 29, 2021 through November 9, 2021, a period of forty-two (42) days; and the fine amount shall continue to accrue at Twenty -Five Dollars ($25.00) per day until compliance is achieved. The Respondent is further assessed One Hundred Eighty -Six Dollars and Ninety -Six Cents ($186.96) for administrative costs incurred by the Village for the November 9, 2021 hearing. Administrative costs in the amount of One Hundred Ninety -Five Dollars and Ninety - Two Cents ($195.92) for administrative costs incurred by the Village for the September 14, 2021 hearing are also reaffirmed. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exists and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes.
