BACKGROUND St. Jude Catholic Church is an existing structure that meets the definition of Place of Assembly in the Mixed -Use Zoning District. On July 11, 2019, the subject applicant was approved for the demolition and replacement of an existing cross structure with a new 29 ft. high cross to be located at the east elevation of the building, see below photo. On August 12, 2021, Village Council heard and approved application SEU 3-21 for a Special Exception Use modification (Place of assembly) to install a new 32 ft. high freestanding cross structure in the front yard fronting US Highway One. The subject application requires a site plan review per Village Code Section 78-331. Required; development standards; required facilities and infrastructure. 2 "By the terms of this chapter, all permitted uses in all zoning districts except R-1A and R-1, all special exception uses as approved by the village council, all planned residential development (PRD), planned commercial development (PCD), and planned mixed -use development (PMUD), all miscellaneous development and redevelopment, all subdivisions, and all uses or construction lying partially or entirely in special flood hazard areas shall comply with the following: (a) Site plan review is required." The Applicant is requesting approval of SPM 2-21, a site plan modification to install a new 32 ft. high freestanding cross structure in the front yard. III. STAFF ANALYSIS The Applicant is requesting a site plan modification to install a new 32 ft. high freestanding cross structure in the front yard. The height of the proposed free standing cross is in compliance with the Village code: the Mixed -Use district maximum allowable high is 50 ft. The Village code is mute regarding the number or type of sculptures that can be installed on front yards facing a right-of-way. The Village Code does not require a minimum setback for sculptures. The proposed improvement does not increase lot coverage of footprint of the existing church. The applicant has provided elevations, renderings, and other associated drawings, to highlights proposed modifications. Please see proposed cross location and elevation below.
