HomeMy WebLinkAboutMinutes_Planning and Zoning_9/16/2021MINUTES PLANNING AND ZONING BOARD MEETING VILLAGE OF TEQUESTA, FL SEPTEMBER 16, 2021 5:30 PM COUNCIL CHAMBERS CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Janet Strand at 5:31 p.m. A roll call was taken by Community Development Planner, Lance Lilly. Present were: Board Chair, Janet Strand, Vice Chair Steven Eagen, Board Members Elizabeth Schauer, Leslee Dasher, James Hackett, Theresa Maggio, and Sherry Ambrose. Also present were Village Attorney, Matthew Pritchett and Community Development Director, Nilsa Zacarias. APPROVAL OF AGENDA MOTION: Member Schauer made a motion to approve the agenda with the removal of agenda item SPR 1-21. Vice -Chair Eagen seconded the motion. Carried unanimously 5-0. APPROVAL OF MINUTES 2. MOTION: Vice -Chair Eagen made a motion to approve the previous meeting minutes of August 19, 2021. Member Dasher seconded the motion. Carried unanimously 5-0. AGENDA ITEMS 3. SPM 03-21: Application from VILLAGE OF TEQUESTA for a site plan modification to modify the exterior louver color from Benjamin Moore Teal Tones 663 to Sherwin Williams Blueblood SW 6966. The application also includes the change of the bracket color from Benjamin Moore Coconut Grove 1029 to Sherwin Williams Turkish Coffee SW 6076. The subject property is located at 399 Seabrook Road, Tequesta, Florida 33469. Village Attorney, Matthew Pritchett announced the quasi-judicial nature of the item and swore in the Applicant, Christine Merrell. The Board Members disclosed that there was no ex-parte communication. Ms. Merrell explained that the modification of the building was a change of the previously approved Benjamin Moore colors to Sherwin Williams's colors, which would complement the building better. MOTION: Member Schauer made a motion to approve SPM 03-21. Member Dasher seconded the motion. Carried unanimously 5-0. 4. SPM 04-21: Application from TURNBERRY BEACH ROAD LLC, for a site plan modification to install an approximately 811 square foot glass tile mosaic on the south building elevation. The subject property is located at 1500 Beach Road, Tequesta, Florida 33469. Village Attorney Pritchett announced the quasi-judicial nature of the item and swore in the Applicant, George Gentile. The Board Members disclosed that there was no ex-parte communication. Mr. Gentile presented a PowerPoint explaining the nature of his site plan modification at 1500 Beach Road. Mr. Gentile explained the developers were proposing a tile mosaic at the previously approved Seaglass Condominium Building. Mr. Gentile mentioned that the mosaic would not include any lighting. Ms. Zacarias stated the application would require final approval at the Village Council. Member Schauer complimented the design of the mosaic. Member Hackett questioned why the mosaic would not be lit. Mr. Gentile explained the lights were not included due to the sea turtles. MOTION: Member Schauer made a motion to recommend approval of SPM 04-21. Dasher seconded the motion. Carried unanimously 5-0. 5. SPR 01-21: Application from MASTROIANNI FAMILY HEADQUARTERS LLC. for a site plan review to build a four (4) story, 33,274 sq. ft. office building. The application includes a landscaping plan, one (1) monument sign, and other site improvements. The address of the property is 691 N. US Highway 1, Tequesta, Florida 33469. Item was removed from the agenda. 6. Legal Update Village Attorney Pritchett provided an overview of what the Planning and Zoning Board is and what the powers and duties of the Board are. He explained that the Board serves as the P&Z Board, Local Planning Agency and Oversight Committee. He continued by stating the Board as jurisdiction to review land development applications and ordinances and make final approval or recommendations of approval to the Village Council. Further, all meetings of the Board must abide by the Sunshine Law, which must be a publicly known and advertised meeting. Any communication with the Village staff or an applicant must be disclosed at the meeting. Member Hackett mentioned that all the members of the Board live in the Village and if it was necessary to disclose for regular/daily business or viewing while driving by. Mr. Pritchett clarified visiting a site to obtain/gather information about an application would be more in line with a site visit unlike visiting a site for everyday business. Member Hackett had a question pertaining to public records and creating a public record. Village Attorney Keith Davis explained that the Board can request a document especially if it is already a public record. However, the Village's record custodian would hold the Board members are in charge of their own public record and unless it is communication with staff, where the information is held by the Village. STAFF COMMENTS There were no staff comments. PUBLIC COMMENTS There were no public comments. BOARD COMMENTS There were no board comments. ADJOURNMENT MOTION: Member Schauer made a motion to adjourn at 6:01 pm. Member Dasher seconded the motion. Carried unanimously 5-0.
