LOCAL PLANNING AGENCY MEETING
VILLAGE OF TEQUESTA, FL

CALL TO ORDER AND ROLL CALL
The meeting was called to order by Board Chair, Janet Strand at 5:30 p.m. A roll call was taken
by Community Development Planner, Lance Lilly. Present were: Board Chair, Janet Strand,
Vice Chair Steven Eagen, Board Members Elizabeth Schauer, Leslee Dasher, Theresa Maggio,
and Molly Young. Also present were Village Attorney, Amity Barnard and Community
Development Director, Nilsa Zacarias. Absent were: Board Members Ashley Warren and
Marguerite Wilson.
1. APPROVAL OF AGENDA
MOTION: Vice -Chair Eagen made a motion to approve the agenda. Member Maggio
seconded the motion. Carried unanimously 5-0.
2. APPROVAL OF MINUTES
MOTION: Member Dasher made a motion to approve the minutes of the previous
January 21, 2021, meeting. Vice -Chair Eagen seconded the motion. Carried
unanimously 5-0.
AGENDA ITEMS
3. ORDINANCE NO. 07-21: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 78, ZONING. ARTICLE IX. SUPPLEMENTAL
REGULATIONS. DIVISION 10. OCCUPANCY OR USE OF TEMPORARY
STRUCTURES, TRAILERS OR VEHICLES. SECTION 78-612. OTHER USES. TO
PERMIT THE PARKING OF FOOD TRUCK TRAILERS WITHIN VILLAGE
JURISDICTION UNDER CERTAIN CONDITIONS; ALSO AMENDING CHAPTER 78.
ZONING. ARTICLE IX. TO CREATE AN ENTIRELY NEW DIVISION 11. ENTITLED
"MOBILE FOOD VENDORS" IN ORDER TO ESTABLISH LOCAL REGULATIONS
FOR MOBILE FOOD VENDORS IN ACCORDANCE WITH CHAPTER 509, FLORIDA
STATUTES; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-
SECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND
EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A
SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
Board Chair read Ordinance 07-21 into the record. Community Director Zacarias
explained the motivation for ordinance stemmed from various food truck inquiries. Ms.
Zacarias provided a detailed breakdown of the ordinance and checklist. She began by
indicating there is a section of the Code of Ordinances that addresses trailers, but it does
not allow for mobile food trucks as temporary structures.
In addition, Ms. Zacarias mentioned the ordinance would include a new section of the
Code of Ordinance pertaining to the regulation of food trucks. These regulations include
food truck classifications and definitions for each classification. She continued by
explaining that based on State regulations, the Village cannot require food trucks
operators to obtain a permit. However, prior to operating food trucks, potential food truck
operators would need to complete the items on the newly provided checklist to ensure
food trucks abide by health and safety regulations and other accessibility safety -related
issues. Ms. Zacarias also mentioned that the ordinance has a provision prohibiting chairs,
tables, and other outdoor seating -related items in association with food truck operation.
Furthermore, Ms. Zacarias indicated that the ordinance includes a section limiting the
number of days food trucks may be operated, whether food trucks can be parked in
required parking spaces, regulations maintaining adequate egress and ingress, hours of
operation, and access to restroom facilities. Lastly, Ms. Zacarias explained the code
section pertaining to the penalties if there are violations. Attorney Barnard clarified any
violations of such ordinance would be addressed through the Code Enforcement process.
Member Schauer mentioned the ordinance did not address the allowable dress code for
food truck workers. She explained that in the 80's, women selling food from a stand
would wear inappropriate clothing to sell their merchandise. Ms. Zacarias informed the
Board that she would look into her concern. The Board complimented staff on the
checklist.
Member Dasher questioned what would happen if multiple food trucks operate on one
property at the same time. Ms. Zacarias clarified that the property owner would have to
grant permission to each food truck wishing to operate on the property and each would
need to obtain a special event permit.
MOTION: Eagen made a motion to recommend the approval of Ordinance No. 07-21.
Schauer seconded the motion. Carried unanimously 5-0.
