RE: Future Land Use Map/Comprehensive Plan
Amendment — (Referred to as the Glendinning property)
The Spear Group, through their agent Gentile, Holloway, O'Mahoney, and Associates, Inc., are
requesting a Residential Low Density (maximum 0--5 dwelling units/acre) land use designation
on a 0.34 acre parcel of land generally described as lying north of Riverside Drive•, and lying
west of and adjacent to a 15.23 acre parcel that was recently annexed into the Village and
which will be part of an overall proposal development project, if approved. This parcel was
recently voluntarily annexed into Tequesta. The Residential Low Density use request is
consistent with the current County land use of LR-3 which allowed three (3) units per acre
and up to four (4) units to an acre with a PUD. The eventual development of this parcel will
be consistent with this density and will be of a similar land use density assigned to its adjacent
properties. The future land use request will require a change to the Future Land Use (FLU)
Map. Because this parcel was recently annexed, the FLU Map will have to reflect the new
municipal boundaries with the Residential Low Density designation. The entire FLU Map
Series consisting of the General Soils Map, Flood Zone map, Coastal Zone and Conservation
Map and Hurricane Surge Map will have to reflect the municipal boundary change as well.
The proposed FLU request is consistent with the Goals, Objectives and Policies of the Village of
Tequesta Comprehensive Plan. This FLU Map/ (Comprehensive Plan Amendment is a small
scale amendment. It will be transmitted to the State DCA and other appropriate review
agencies for informational purposes, if approved.
The applicant has demonstrated that the impacts of this proposal will not adversely impact
utilities and the road system in the Village. Attached to this application are letters from
ENCON (sewer), the Palm Beach County Solid Waste Authority (solid waste), and the Village
Utilities Department (water) indicating that there are adequate utility capacities to
accommodate this proposal. Additionally, the Village Traffic Consultant has reviewed the
potential impacts of this future land use and has determined that the traffic generated would
be within the transportation level of service standards adopted in the Comprehensive Plan.
The applicant's engineer has submitted a letter assuring that drainage requirements will be met
and stormwater management standards will also be met.
It is recommended that The Village Council approve this proposed Future Land
Use/ Plan Amendment application.

VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING THE COMPREHENSIVE PLAN OF
THE VILLAGE OF TEQUESTA, FLORIDA IN
ACCORDANCE WITH THE LOCAL GOVERNMENT
COMPREHENSIVE PLANNING AND LAND
DEVELOPMENT REGULATION ACT, AS AMENDED,
ADOPTING A SMALL SCALE DEVELOPMENT
AMENDMENT TO THE FUTURE LAND USE MAP IN THE
AREA DESIGNATED ON THE ATTACHED EXHIBIT,
APPLYING A RESIDENTIAL LOW DENSITY LAND USE
CLASSIFICATION TO A PORTION OF REAL PROPERTY
LOCATED ON THE NORTH SIDE OF RIVERSIDE DRIVE,
WEST OF AND ADJACENT TO A 15.23 ACRE PARCEL
REFERRED TO AS THE ROOD PROPERTY,
CONTAINING APPROXIMATELY 0.34 ACRES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, pursuant to Section 163.3161 et seq., Florida Statutes, being the
Local Government Comprehensive Planning and Land Development Regulation
Act, the Village of Tequesta may adopt amendments to the Comprehensive Plan;

WHEREAS, pursuant to Section 163.3179, Florida Statutes, the Village may
make small scale development amendments pursuant to the provisions of said
statute; and
WHEREAS, the Local Planning Agency of the Village of Tequesta has held a
public hearing to make recommendation to the Village Council and has
recommended the adoption of the amendments to the Comprehensive Plan
contained herein; and
WHEREAS, the Village Council wishes to approve and adopt a small scale
amendment to the Land Use Map of the Village as set forth on Exhibit "A"
attached hereto.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:

Section I. The Village Council of the Village of Tequesta, Florida, does hereby
amend the Comprehensive Plan of the Village in accordance with the Local
Government Comprehensive Planning and Land Development Regulation Act, as
amended, adopting a small scale amendment to the Future Land Use Map in the
area designated on the attached exhibit, applying a residential low density land
use classification to a portion of real property located on the north side of
Riverside Drive, west of and adjacent to a 15.23 acre parcel referred to as the
Rood Property, containing approximately 0.34 acres.
Section 2. Severability. If any provision of this Ordinance or the application
thereof is held invalid, such invalidity shall not affect the other provisions or
applications of this Ordinance, which can be given effect without the invalid
provisions or applications, and to this end, the provisions of this Ordinance, are
hereby declared severable.
Section 3. Repeal of Ordinances in Conflict. All other ordinances of the
Village of Tequesta, Florida, or parts thereof which conflict with this or any part
of this Ordinance are hereby repealed.
Section 4. Codification. This Ordinance shall be codified and made a part of
the official Code of Ordinances of the Village of Tequesta.
Section 5 Effective Date. This Ordinance shall take effect immediately upon
its passage and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember

The Spear Group, through their agent Gentile, Holloway, O'Mahoney, and Associates, Inc., are

on a 0.29 acre parcel of land generally described as lying north of Riverside Drive; and west of
and adjacent to a 15.23 acre parcel recently annexed into the Village and which will be
combined with that parcel as an overall proposed development project, if approved. The
