Please fund attached, Code of Ordinances Section 19-14, Stormwater Utility Board, that shows
the months (April and May) the Utility Board must meet to review capital projects and establish
stormwater utility rates.
The Village Council must approve this rate and the residents must be notified during the month
of August. Attached is a copy of a letter mailed to the residents during that month.
Please advise if you should require any assistance in this matter.

§ 19-13 sTORMWATER VaLITX
See. 19-1.3. Program responsibility.
§ 19-15
It shall be the duty of the director to administer the stormwater
management utility. The director shall keep an accurate record of
all persons using the services and facilities of the stormwater
management system of the village and to make changes in
accordance with the rates and charges established by this chapter
and accompanying ordinances.

A stormwater utiiitpboard is hereby created consisting of the
members of the village council.
The board shall meet a minimum of two (2) tiznes per year
during ,April and May to review the next fiscal year's capital
projections list and to set budget priorities for the next fiscal year.
In addition, the board shall comment on the goals and priorities
of the stormwater utility on an annual basis and meet a$
necessary to hear appeals of rates.

Sec. 19-15. Flooding; liability.
Floods from stormwater runoff May occasionally occur which
exceed the capacity of storm drainage facilities constructed,
operated or maintained by funds made available under this,
chapter. This chapter shall not be construed or interpreted to
mean that property subject to the fees and charges established
herein will always (or at any time) be free from stormwater
flooding or flood damage, or that stormwater' systems capable of
handling all storm events can be cost-effectively constructed,
operated, or maintained. Nor shall this chapter create any
liability on the part of, or cause of action against, the village, or
any official or employee thereof, for any flood damage that may
result from such storms or the runoff thereof. Nor does this
chapter purport to reduce the need or necessity for obtaining flood
insurance by individual property owners..

The assessment pays for the debt and operating costs associated with the Stormwater Utility
System. The Stormwater Utility provides this community.with the means to address Federal
mandates concerning water quality as in the National Pollutant Discharge Elimination System
(NPDES), permitting program associated .with stormwater;runoff: and for .flood -.control
.improvements• and :associated .infrastructure repair.. and .maintenance. .,Your;: assessment is.
based upon the type of property you have and/cir the amount of.impervious surface located
on your property, alf of which is a factor of the engineering. concept •referred to as the
Equivalent Residential Unit_ (ERU). The. proposed assessment is.,.4.5% .higher than the
previous years assessment and is" necessary to .provide the :revenues .needed to balance the
proposed .Stormwater Utility Fund Budget for FY 2000..- Upon receipt of .your property.tax
bill on or about November I", you can receive a 4% discount on this assessment, other
assessments; and your property taxes if you pay your property tax bill in November.
Please find the details* of your proposed Tequesta Stormwater Utility assessment on the
reverse side of this letter. Your proposed assessment is preliminary and will either remain
the same or decrease on your final tax bill. If you have any questions or concerns about
your assessment, please feel free to contact the Village Staff at (561) •575-6234. You are also
welcome to attend the annual public hearing on September-9, 1999 at the Village Hall
Council Chambers located at 3S7 Tequesta Drive in Tequesta at 7:00 p.m.
