ORDINANCE NO. 03-22 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 62. ARTICLE IV. DIVISION 1. SECTION 62-92. LEVEL OF SERVICE STANDARDS. AND AT CHAPTER 66. ARTICLE V. DIVISION 1. SECTION 66-161. GENERAL STANDARDS; LEVEL OF SERVICE STANDARDS. AND AT CHAPTER 78. ARTICLE IX. DIVISION 2. SECTION 78-331. TO UPDATE THE PARKS AND RECREATION LEVEL OF SERVICE (LOS) STANDARD IN CONFORMANCE WITH THE VILLAGE COMPREHENSIVE PLAN AND TO PROVIDE GENERAL CONSISTENCY EDITS THEREIN; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB -SECTION OF CHAPTERS 62, 66, AND 78 OF THE CODE OF ORDINANCES OF THE VILLAGE OF TEQUESTA SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village of Tequesta, Florida (the "Village") is a duly constituted municipality having zoning and land use regulatory authority as conferred upon it by the Florida Constitution and Chapters 163 and 166, Florida Statutes; and WHEREAS, Section 62-92 of the Village Code of Ordinances provides for the Level of Service ("LOS") standards adopted to ensure concurrency of future development in the Village for the provision of public facilities and services; and WHEREAS, Sections 66-161 and 78-331 requires all new development or redevelopment within the Village to provide necessary public infrastructure and facilities to meet specified LOS standards; and WHEREAS, the Village updated its Comprehensive Plan in 2018 and amended the Parks and Recreation LOS standard during this 2018 update; and WHEREAS, an amendment to the Parks and Recreation LOS standard within Sections 62-92, 66-161 and 78-331, Village Code is necessary to conform with the corresponding Parks and Recreation LOS standard within the Village's Comprehensive Plan; and WHEREAS, the Village of Tequesta has held all required public hearings and has provided public notice in accordance with applicable State statutes and Village ordinances; and WHEREAS, the Village Council of the Village of Tequesta has determined that the Page 13 of 23 Agenda Item #2. proposed revisions to the Village Code of Ordinances are in the best interests of the citizens of the Village of Tequesta. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: Chapter 62. Planning and Development. of the Code of Ordinances of the Village of Tequesta is hereby amended at Article IV. Adequate Facilities and Concurrency Management. Division 1. Generally. Section 62-92. Level of service standards. to update the Parks and Recreation Level of Service (LOS) standard in conformance with the Village Comprehensive Plan and to provide general consistency edits therein; providing that Section 62- 92 shall hereafter read as follows: Sec. 62-92. Level of service standards. The following level of service standards have been adopted in the capital improvements element of the comprehensive plan and shall be used by the village to ensure concurrency of future development within the corporate limits of the village with the provision of public facilities and services: (1) Traffic (roads and rights -of --way). Roadway Type (LOS) (LOS) Peak Standard Village Collector Roadways* C D, *Except Country Club Drive and Seabrook Road which are LOS Standard C Urban minor arterials C D Urban Principal arterials C D (2) Sanitary sewer. A central wastewater level of service standard of 108 gallons per capita per day is hereby adopted, and shall be used as the basis of estimating the availability of capacity and demand generated by a proposed development project. (3) Drainage. A public drainage facilities level of service standard of a 25-year frequency, 24-hour duration storm event is hereby adopted, and shall be used as the basis of estimating the availability of capacity and demand generated by a proposed development project. As a general drainage requirement, each proposed project and/or site shall maintain 95 percent of all stormwater runoff on -site. Page 14 of 23 Agenda Item #2. (4) Potable neater. The following potable water level of service standards are hereby adopted and shall be used as the basis for estimating the availability of facility capacity and demand generated by a proposed development project: a. Subdivisions. of the Code of Ordinances of the Village of Tequesta is hereby amended at Article V. Design Standards. Division 1. Generally. Section 66-161. General standards; level of service standards. to update the Parks and Recreation Level of Service (LOS) standard in conformance with the Village Comprehensive Plan and to provide general consistency edits therein; providing that Section 66-161 shall hereafter read as follows: Sec. 66-161. General standards; level of service standards. [Subsections (a) — (f) left in full force and effect as previously adopted.] (g) All new development and redevelopment must provide the necessary infrastructure to meet the following level of service standards (LOS). Each application submitted pursuant to this section shall be required to provide a certification from a licensed engineer in the state that Page 15 of 23 Agenda Item #2. the proposed development and/or redevelopment meets or exceeds the level of service standards for the listed infrastructure as follows: (1) Traffic (roads and rights -of --way). Zoning. of the Code of Ordinances of the Village of Tequesta is hereby amended at Article IX. Supplemental Regulations. Division 2. Site Plan Review. Section 78-331. Required; development standards; required facilities and infrastructure. to update the Parks and Recreation Level of Service (LOS) standard in conformance with the Village Comprehensive Plan and to provide general consistency edits therein; providing that Section 78-331 shall hereafter read as follows: Sec. 78-331. Required; development standards; required facilities and infrastructure. By the terms of this chapter, all permitted uses in all zoning districts except R-lA and R-1, all special exception uses as approved by the village council which also include additional exterior modifications, all requests to expand, enlarge or revise the site of an existing small scale exterior or large scale special exception use, all planned residential development (PRD), planned commercial development (PCD), and planned mixed -use development (PMUD), all miscellaneous development and redevelopment, all subdivisions, and all uses or construction lying partially or entirely in special flood hazard areas shall comply with the following: [Subsections (a) — (g) left in full force and effect as previously adopted.] (h) All new development and/or redevelopment must provide the necessary infrastructure to meet the following level of service standards. Section 5: All Ordinances or parts of Ordinances in conflict be and the same are hereby repealed. Section 6: Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. Section 7: Specific authority is hereby granted to codify this Ordinance. Section 8: This Ordinance shall take effect immediately upon passage. Page 19 of 23
