CHIEF OF POLICE
COMMEMORATIVE SERVICE AWARD AGREEMENT
I
Agreement is made and entered into this -2 day of June, 2006, by and
between the VILLAGE OF TEQUESTA ("Village"), a municipal corporation located in
Palm Beach County, Florida, and S', �,�� /���.;�.� Chief of Police upon his
retirement from service to the Village.
RECITALS:
WHEREAS, the Village would like to commemorate the Chiefs years of service
to the Village as Chief of Police by presenting the Chief with his service issued
handgun;
WHEREAS, Section 112.193(2), Fla. Stat. provides that municipal employers
may present to each such employee who retires under any provision of a state or
municipal retirement system one complete uniform including the badge worn by that
officer, the officer's service handgun, if one was issued as part of the officer's
equipment, and an identification card clearly marked "retired."
WHEREAS, Section 112.193(4), Fla. Stat. further provides, "Each uniform,
badge, service handgun and identification card presented under this section is to
commemorate prior service and must be used only in such manner as the employer
prescribes by rule."
ACCORDINGLY, in consideration of the mutual representations, warranties,
covenants and other terms and conditions contained herein, and other good and
valuable consideration, the sufficiency of which is hereby acknowledged, the parties
agree as follows:

1. The Village of Tequesta will present the Chief of Police with his handgun
upon retirement.
2. The Chief of Police understands and agrees that the firearm is to be used
for commemorative purposes only, and not for any other purposes.
3. The Chief of Police hereby releases and forever discharges the Village of
Tequesta, and agrees to indemnify, defend, and hold the Village of Tequesta and its
agents, employees, elected officials, and representatives free and harmless from and
against any and all claims, losses, expenses, suits, costs, fines and damages (including
attorney fees) or liabilities of every kind and character arising out of or relating to any
improper use of the commemoratively awarded handgun.
IN WITNESS WHEREOF, the parties hereto have executed this Commemorative
Service Award Agreement as of the date and year first above written.
