The Village Council approved the application for a Site Plan Review Approval in Case No. SPR 01-16 on January 12, 2017. 2. The Site Plan Review Approval for Case No. SPR 01-16 was set to expire January 12, 2018 but was extended until January 12, 2022 based on several emergency - related state Executive Orders, as specified in Applicant's Request for Time Extension and supporting documentation which is attached to this Order as Exhibit A. 3. According to Section 78-334(h) of the Village of Tequesta Code of Ordinances, a building permit must be issued within one year of the date of the site plan approval or the approval shall be nullified ... "unless such time period is extended for one more year only by the village council upon written request of the Applicant, submitted to the village, prior to expiration of the site plan." The Applicant has made a written request for a twelve (12) month extension of the Order granting the Site Plan approval in this case so that it will have time to obtain to obtain all necessary permits and commence construction. 5. According to Section 78-334(h) of the Village of Tequesta Code of Ordinances, the Village Council has the right, power and authority to grant the extension being requested by the Applicant. 6. In the judgment of the Village Council of the Village of Tequesta, the public convenience and welfare will best be served by approving the request for an extension. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The request for extension of time for Site Plan Review Approval, SPR 01-16, Key Estates Tequesta Senior Housing, LP, with references to the property described herein, located in the Village of Tequesta, Palm Beach County, Florida, to allow the Applicant: A twelve (12) month extension of time for the Site Plan Approval granted in Case No. SPR 01-16; said extension of time to commence on January 12, 2022, is HEREBY APPROVED in accordance with the Village Zoning Code, Sec. 78-334(h). All other conditions of approval of SPR 01-16 and SEU 02-16 shall remain in full force and effect as previously ordered by the Village Council.
