I. BACKGROUND
Gallery Square South has been in the Village of Tequesta since the 1950's. In 2016, Perk Coffee
House located their business in the Gallery Square South Plaza. In 2017, the business applied for
a variance to serve alcoholic beverages and was approved by the Village Council.
Per Section 78-176 (d) (2), Shopping Centers are considered Special Exception Uses in the C-1
zoning district.
On February 10, 2022, the Village Council heard a special exception use for the installation a six
(6) foot high dumpster enclosure with 112 square foot concrete slab in the parking area and
interior building renovations to increase one of the tenant spaces by 1,273 square feet.
Currently at the Gallery Square South Plaza, each tenant uses individualized waste collection bins
and does not have a dumpster on the property. The proposed dumpster and dumpster enclosure
would be solely for Perk Coffee House. However, at the hearing, Council suggested that the
dumpster accommodate other tenants within the plaza. The subject Special Exception Use
aaalication was heard and a►naroved by Council (5-0) at the February 10. 2022 Villaae Council
meeting.

STAFF ANALYSIS
The Applicant is requesting a site plan modification to install a six (6) foot high dumpster enclosure
with 112 square foot concrete slab in the parking area per Sec. 78-300. The subject property is
located at 384 Tequesta Drive, Tequesta, Florida 33469.
Currently, the plaza utilizes individualized waste collection bins and does not have a dumpster on
the property as shown in the below photo.
In terms of parking calculation, the Village code refers to the following parking requirements for
Shopping Centers: "Sec. 78-705 (30) (b), "(32) Shopping centers: One space per 250 square feet
of gross leasable area (GLA)."
Currently, Gallery Square South has a total square footage of 11,646 square feet. Based on the
plaza's square footage, the plaza is required to have 47 parking spaces. However, the plaza has a
total of 85 parking spaces, which exceeds the requirement by 38 parking spaces.
II. FINAL REMARKS
This subject site plan modification application met the requirements set on Section 78-368 notice
of hearing. The notice of hearing will be advertised in the Palm Beach Post on February 7, 2022
2022.
Waste Management has reviewed the proposed dumpster location and had no comments
regarding the ingress/egress of the site. "Waste Management of Martin County can adequately
accommodate the prescribed services." Please see attached letter from Waste Management.
On February 10, 2022, the subject Special Exception Use application was heard and approved by
Council (5-0). At the hearing, Council suggested that the dumpster accommodate other tenants
within the plaza.

RE: Revised Application for Site Plan Modification, Addition of Dumpster Enclosure — Perk
Coffee House, 384 Tequesta Drive, Tequesta, FL
Dear Mr. Lilly:
A second revised site plan modification application for the proposed dumpster at Perk Coffee House
was submitted on December 16, 2021. In an email dated December 28, you provided some
additional comments on the application, as indicated below:
1. Revise description of work on Page 1 of the site plan modification application to include the
proposed dumpster square footage and location.
2. Revise survey to include the following:
• Existing and proposed pervious/impervious calculations (the impervious/pervious
calculations were included on a previous submittal but not on the most recent submittal)
• Existing and proposed parking calculations
• Revised dumpster enclosure location to include where/how the enclosure doors will open
3. Provide color of the proposed metal dumpster enclosure door.
Comment 1 has been addressed within the attached Village of Tequesta Site Plan Modification
Application form. Attached plans address comments under #2. As the dumpster will be placed in
an area that is currently occupied by two bituminous parking spaces, there will be no net change in
the ratio of pervious to impervious ground at the site. In addition, the loss of two parking spaces
will result site parking to go from 85 to 83 spaces, and the required number of spaces for the plaza
is only 47. Therefore, site parking will not be adversely impacted. Lastly, the dumpster enclosure
opening, which will face west, will be fitted with two steel gates, one swinging open to the north
and one to the south. The steel gates will be painted in the neutral beige color that the plaza
building is currently painted.
In your comment letter dated December 28, 2021, you also stated "Community Development
contacted Waste Management about the proposed dumpster enclosure installation. Waste
Management conducted an inspection on December 27, 2021 and had no objection to the dumpster
location".
Lastly, in your staff review comments, you indicated that the proposed dumpster enclosure
application requires a special exception use modification, which will be heard by the Village Council
prior to being heard by the Planning and Zoning Board. Accordingly, a Special Exception Use
Application has been filed with the Village of Tequesta to address this comment.
Thank you for your attention to this matter and I look forward to receiving approval from the Village
of Tequesta so we can proceed toward construction as soon as possible. Please contact me with
