FIRST ADDENDUM TO DIRECTOR OF
COMMUNITY DEVELOPMENT CONSULTANT AGREEMENT
THIS FIRST ADDENDUM TO DIRECTOR OF COMMUNITY
DEVELOPMENT CONSULTANT AGREEMENT ("First Addendum"), made and
entered into this _ day of May 2022, effective immediately, by and between NZ
Consultants, Inc., a Florida corporation with offices located at 1851 West Indiantown
Road, Suite 100, Jupiter, Florida 33458, hereinafter the "Consultant", and the Village of
Tequesta, Florida, a municipal corporation organized and existing in accordance with the
laws of the State of Florida with offices located at 345 Tequesta Drive, Tequesta, Florida
33469, hereinafter referred to as the "Village", both of whom agree that the current
"Director of Community Development Consultant Agreement" (hereinafter the
"Agreement"), made and entered into by the Consultant and the Village on the 12th day of
August, 2021, effective October 1, 2021, is hereby amended in the following manner:
Section 1: Section 1 of the Agreement entitled `Scope of Services' is hereby
amended to create an entirely new subsection £ entitled `Additional Services - R-3
Zoning District Project', to allow for the Consultant's provision of additional services
outside normal duties as permitted upon mutual agreement of the Consultant and Village
Manager pursuant to Section I.e. of the Agreement, providing that Section l.f. of the
Agreement shall hereafter read as follows:
1. Scope of Services:
f. Additional Services - R-3 Zoning District Project: The Consultant and the
Village Manager hereby agree on the Consultant's provision of additional services
related to an update to the Village's R-3 Zoning District regulations as follows:
1) Review and Analysis of Model R-3 Design Features: The Consultant shall
review and analyze model code examples for the purpose of incorporating
new building design standards which may include scaled down height,
building massiveness and articulations including the skyline, mid -section
(balconies, windows, etc.) and ground floor (arcaded, canopies, etc.).
2) R-3 Zoning Code Text Amendment Process: Following the review and
analysis in subpart (1) above, the Consultant shall implement and oversee

the following process to adopt a Zoning Code Text Amendment that
incorporates new building design standards into the Village R-3 Zoning
District Code:
a) One (1) Initial Workshop with Village Council and Residents. At the
Initial Workshop, Consultant will listen and gather feedback, input,
ideas and recommendations from Village residents and Village
Council related to the proposed design standards for the R-3 Zoning
District. Consultant shall prepare and deliver a slideshow presentation
addressing the proposed Code updates.
b) Draft Text Code based on the Initial Workshop. Following the Initial
Workshop, Consultant shall work with the Village's Landscape
Architect and General Counsel to draft an ordinance that amends the
Village's R-3 Zoning Code regulations relative to design standards.
c) One (1) Follow Up Workshop with the Village Council and Residents.
Following Consultant's preparation of a draft ordinance implementing
the R-3 Zoning Code Text Amendment, Consultant shall present the
proposed design standards language to gather any additional feedback
or recommendations from residents and Village Council.
d) Text Amendment Adoption Process. Consultant shall initiate the
ordinance approval process for the R-3 Zoning Code Text Amendment
through the Local Planning Agency ("LPA") and Second Reading of
the Village Council.
In consideration for the above -referenced services, the Village shall pay the
Consultant an amount not to exceed Eight Thousand, Five Hundred Dollars
($8,500.00), with any costs in excess of this amount requiring Village Council
approval.
Section 2: All other Sections, terms and conditions of the above -referenced
Agreement shall remain in full force and effect.
Section 3: This First Addendum shall be attached to the current Agreement
and shall become a part thereof.

IN WITNESS WHEREOF, the Contractor has signed and executed this First
Addendum; and the Village has caused this First Addendum to be signed and executed on
its behalf by its Village Manager, with an effective date as noted above.
