Regular Council STAFF MEMO Meeting: Regular Council - Jun 09 2022 Staff Contact: Matthew Hammond, Utilities Department: Utilities Director Authorize Work Authorization No. 2 with Hinterland Group, Inc. for Stormwater Collection System Rehabilitation Services The Utilities Department is responsible for the operation and maintenance of the stormwater system which includes over 10 miles of pipes/culverts, 511 catch basins, 12.6 miles of conveyance swales/ditches, ponds and 4 major outfalls in accordance with our National Pollutant Discharge Elimination System (NPDES) permit. Part of the routine maintenance is to inspect the condition of components of the stormwater system and identify failures in the system. As a result of these detailed inspections by utilities staff, two segments of 24" stormwater pipe located within the Tequesta Country Club (TCC) golf course have been identified as rehabilitation. Both segments, while located on TCC golf course property, connect segments of the Village stormwater system. To achieve the lowest possible pricing, Village staff recommends that the stormwater pipe segments be lined using the cured -in -place pipe (CIPP) method through the existing piggyback agreement with the Hinterland Group. The original term of the agreement extended through September 30, 2021 can be extended for two additional one-year terms by mutual consent of both parties. Charlotte County has exercised their first renewal option, as a result, the Village's piggyback agreement automatically renews through September 30, 2022. Work Authorization No. 2 includes the lining, rehabilitation and ancillary work to rehabilitate two pipe segments totaling 479 feet. The cost to complete this work is $54,742.00. Piggyback contracts are a form of intergovernmental cooperative purchasing in which an entity is extended the pricing and terms of a competitively awarded contract by another federal, state or municipal government. When used correctly, piggyback contracts can save Village time and resources and leverage spending through economies of scale. PROJECT WORK AUTHORIZATION NO.2 WITH HINTERLAND GROUP FOR STORMWATER COLLECTION SYSTEM REHABILITATION PROJECTS THIS PROJECT WORK AUTHORIZATION NO. 1 is entered into and effective this day of by and between the VILLAGE OF TEQUESTA, a Florida municipal corporation with offices located at 345 Tequesta Drive, Tequesta, Florida 33469-0273, organized and existing in accordance with the laws of the State of Florida, hereinafter the "Village"; and HINTERLAND GROUP, INC., a Florida corporation with offices located at 2051 West Blue Heron Boulevard, Riviera Beach, Florida, 33404, hereinafter the "Contractor" and collectively with the Village, the "Parties". 1.0 Authorization This Project Work Authorization is issued pursuant to the Agreement for Pipeline Continuing Construction services between the Village and the Contractor, dated April 8, 2021, hereinafter the "Agreement". If there are any conflicts between the terms and conditions of this Project Work Authorization and the Agreement, the terms and conditions of the Agreement shall prevail. 2.0 Project Description: The Utilities Department has identified a need to line approximately 479 linear feet of stormwater conveyance piping including associated cleaning and repair services. 3.0 Scope of Services Under this Project Work Authorization, the Contractor will provide the construction services to the Village as detailed in the scope of work incorporated herein as Exhibit "A". 4.0 Schedule The services to be provided under this Project Work Authorization shall be Substantially Complete within thirty (30) calendar days and Finally Complete within forty -eve (45) calendar days from the Village's issuance of a Notice to Proceed. 5.0 Liquidated Damages Contractor shall pay the Village $50 for each day that expires after the time (as duly adjusted pursuant to the Agreement) specified in the Schedule above for Substantial Completion or Final Completion until the Work is substantially complete or finally complete respectively. 6.0 Compensation In consideration for the above Scope of Services and within the Agreement, pricing shall be pursuant to the Agreement. In consideration for the above Scope of Services and pursuant to Exhibit "B", the Village shall pay the Contractor a total amount not to exceed fifty-four thousand, seven hundred forty-two dollars and zero cents ($54,742.00). EXHIBIT A Page 559 of 565 Agenda Item #23. 1.0 2.0 EXHIBIT A - SCOPE OF WORK SUMMARY OF WORK The project components generally include mobilization, general conditions, bonds, insurance, pre - and post -television surveys, pipe cleaning, furnish and install cured -in -place stormwater pipe, grouting pipe terminations, bypass pumping, disposal of materials, permit compliance, maintenance of traffic and pedestrian access around the sites, utility coordination, and surface restoration. The work included in this Work Authorization include: Item 1 a — TV Survey: Pre and Post Construction Survey 479 LF Item 2 — Warranty 479 LF Item 3a — Light Cleaning (16"-29") 479 LF Item 12 — 24" Cured in Place Pipe- 10.5mm 479 LF Item 50 — Disposal of Materials 68 CY Item 51 — Mobilization 1 EA Divers to Install Plug 12 HR The specific locations for stormwater pipe lining and repair under this Work Authorization are identified in Attachment A. Notes: 1. The Contractor has visited the work sites and determined that Light Cleaning (Bid Item No. 3), as defined in the underlying piggyback agreement, is warranted for this project and will be applied to this project. MAINTENANCE OF TRAFFIC A) In the Contractor's use of streets and highways for the Work to be done under these Specifications, conform to all Municipal, County, State and Federal laws and regulations as applicable. Provide, erect and maintain effective barricades, warning lights, and signs on all intercepted streets or highways for protection of the Work and safety of the public. All barricades or obstructions which encroach on or are adjacent to the public rights of way should be provided with lights which are illuminated at all times between sunset and sunrise. B) Contractor shall schedule Work to cause minimum disturbance of normal pedestrian and vehicular traffic and be responsible for providing suitable means of access to all public and private properties during all stages of the construction. Other than for an emergency safety condition, the Contractor must contact the Owner for approval prior to completely blocking off any street to vehicular traffic during construction. Contractor shall provide written notification to emergency, police, fire and other appropriate agencies at least 24 hours in advance of new work or changed work. C) Maintain traffic in accordance with Section 102 of the Florida Department of Transportation Standard Specifications for Road and Bridge Construction, 2007 Edition, except as follows: a. Contractor is responsible for preparing a Maintenance of Traffic plan. Submit plan for Owner or roadway authority (City, County, D.O.T.) review. The Maintenance of Traffic plan must be prepared by a person who is certified by an FDOT certified school or an engineer licensed in the State of Florida. b. Maintenance of Traffic is considered incidental to the work and no separate payment will be made. Page 560 of 565 Agenda Item #23. 3.0 HOURS OF WORK Contractor shall comply with the Local Code and Ordinances which regulate noise, equipment operation, and work hours. Work may commence at 7:00 AM and cease at 5:00 PM. Weekend work may commence with prior written authorization. 4.0 COORDINATION OF WORK The Contractor shall coordinate access and timing of work with the Tequesta Country Club. 5.0 RESTORATION All work areas, including ingress/egress corridors, shall be restored to equal or better conditions. 6.0 TEMPORARY FACILITIES & CONTROLS A) The Contractor is responsible for compliance with all NPDES regulations including submitting a Pollution Prevention Plan, submitting a Notice of Intent, conducting maintenance and inspection of controls, erosion and sediment controls and submitting a Notice of Termination. B) As part of the Work, the Contractor shall be responsible for applying for, obtaining and complying with all required dewatering permits. Contractor shall notify South Florida Water Management District (SFWMD) prior to all dewatering activities. All dewatering shall meet SFWMD requirements. C) Contractor shall install all turbidity control devices required, if necessary. Contractor shall notify permitting agencies for inspection of turbidity control devices prior to any construction activities. 7.0 INSURANCE A) Contractor shall furnish documentation of required insurance, as identified in the underlying piggyback agreement, within fourteen (14) calendar days after execution of a Work Authorization. 8.0 WARRANTY All work shall be fully warranted for 1-year from the date of substantial completion. Due to the poor condition of the original host pipe, residual settling may appear at the surface grade post lining. This condition is not covered under warranty. Unforeseen conditions can affect the amount of time to complete the work, therefore increasing or decreasing estimate.
