AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, ADOPTING A
COMPREHENSIVE PLAN FOR THE VILLAGE OF
TEQUESTA IN ACCORDANCE WITH THE "LOCAL
GOVERNMENT COMPREHENSIVE PLANNING AND LAND
DEVELOPMENT REGULATION ACT" AS AMENDED,
BEING SECTIONS 163. 3161 ET. SEQ. , FLORIDA
STATUTES; ATTACHING AS EXHIBIT "A" A COPY
OF THE COMPREHENSIVE PLAN; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE,
AND AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, pursuant to Sec. 163. 3161, et. seq. , Florida
Statutes, the "Local Government Comprehensive Planning and Land
Development Regulation Act" the Village of Tequesta, Florida,
is required to adopt and periodically amend a Comprehensive
Plan; and
WHEREAS, on or about March 30, 1989, the Village
Council, sitting as the Local Planning Agency, held a Public
Hearing to make recommendations to the Village Council as to
the transmittal of the revised Comprehensive Development Plan
to the State of Florida, Department of Community Affairs; and
WHEREAS, on or about March 30, 1989, the Village
Council held a Public Hearing to consider the recommendations
of the Local Planning Agency and to consider the transmittal of
the revised Comprehensive Development Plan to the State of
Florida, Department of Community Affairs; and
WHEREAS, on or about March 31, 1989, the Village
Council transmitted its revised Comprehensive Development Plan
to the State of Florida Department of Community Affairs for
comment; and
WHEREAS, on or about July 14, 1989, the Village of
Tequesta received the Comments, Recommendations and Objections
Report from the State of Florida, Department of Community
Affairs;
WHEREAS, on September 14, 1989, the Village Council,
sitting as the Local Planning Agency, held a Public Hearing to
review the Comments, Recommendations and Objections Report from
the State of Florida, Department of Community Affairs and to
make recommendations to the Village Council concerning the
adoption of the revised Comprehensive Development Plan; and
WHEREAS, on September 14, 1989, the Village Council
considered the recommendations of the Local Planning Agency and
approved, on first reading, this Ordinance adopting the revised
Comprehensive Development Plan; and
WHEREAS, on October 12, 1989, the Village Council
held a Public Hearing to consider adoption of the revised
Comprehensive Development Plan and thereafter, on second
reading, adopted this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: Pursuant to the provisions of the "Local
Government Comprehensive Planning and Land Development
Regulation Act", Section 163. 3161 et. seq. , Florida Statutes,
the Village of Tequesta, Florida, hereby adopts the
Comprehensive Development Plan of the Village of Tequesta,
Florida. A copy of the Comprehensive Development Plan of the
Village of Tequesta, Florida is attached hereto and made a part
hereof as Exhibit "A".
Section_2_: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 3: Should any section or provision of this
Ordinance or any portion thereof be declared by a Court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 4: This Ordinance shall take affect
immediately upon passage.
THE FOREGOING ORDINANCE was offered by
Councilmember who moved its
adoption. The Ordinance was seconded by
Councilmember , and upon being put
to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly
