policies that affect the environment. |nour discussions, mwe have occasionally referenced the
SeaCS|assproject southofCona|Coveandexpressed displeasure that aconcrete pad from the
prior owner was not removed and that a section of dune was not restored in, its place. Asitis,
there isagap inthe dune line |nthat area, and the concrete structure will likely exacerbate any
future erosion ofsand irthat area. As«vework through the codes, vVenotice that there is
nothing toindicate that the concrete pad should not have been allowed toremain.
We are aware that there are current plans and near -future plans to develop and/or redevelop
properties in this zone (the R3 zoning district). We are also aware that a healthy dune system is
an essential factor in retention of sand., a boon to native plants and wildlife," a natural buffer
between natural forces and property, a source of protection for the human I Wes that I ive in
those properties, and an economic buffer for the Village in the face of CrIlmate change and rising
costs of beachrenmurishrnent.
VVerecommend that the Council consider changing the codes torequire any development or
redevelopment inthis zone torebuild and maintain ahealthy, natural dune system, planted
with the native plants naturally occurring inthe existing dunes inthis area. We recommend
that such a code would require removal ofstructures that prevent rebuilding of the dune,
effectively pulling the developed footprint back from what would and should be the dune line.
When looking through our Codes, we notice that there is insufficient protection of dunes. Most
codes that pertain to the dunes, defer to Florida D.E.P, essentially protecting dunes and/or
granting construction related permissions lfD.E.P. does so. For example...
"'Sec. 78-842. 'Limitations on sites in coastal high hazard areas (zone V).
In coastal hi-gh hazard areas, alteration of sand dunes and mangrove stands shall be permitted only -if such
alteration is approved by the Florida Department of Environmental Protection and only of the engineering analysis
required by section 79-803(4) of this article demonstrates that the proposed alteration will not increase the
potential for flood damage. Construction or restoration of dunes under or around elevated buildings and
structures shall comp|ywith section 7g'g6lofthis article.

While m/elike that the code mentions "Improving dune heights inareas oflow dune profile" and
lf�planting natural vegetation," the code only encourages this type of activity.
We should be requiring dune preservation and improvement.
Our code contains a chart that includes setbacks for the zones in the Village; the chart does not
appear1oczntainaseibackinme|ationtodunes,anddunesaneon|yrnendonedinre|ationto
the height of construction (Sec. 78-143).
Our Northern Palm Beach County neighbors (Juno^Jupiter,]upiter|n|etCo|onies)aUaddress
dune preservation in relation to coastal construction.
Ofthe three Northern County neighbors, Jupiter Inlet Co|ony'sCode contains the least robust
dune protection, but their code still appears stronger than ours. We do not recommend using
their code as a guide, but here it Is:
Sec. 4-42. - Location of construction.
Construction, except for elevated walkways, lifeguard support stands, piers, beach access ramps,
gazebos, and coastal o'share protection structures, shall belocated a sufficient distance landward ofthe

excavation, may occur tothe extent that the natural storm buffering and protection capability ofthe dune

Jupiter's code and Juno's code are much more robust and preferable. Here is Jupiter's code:
"Sec. 21-248. Ocean -front setbacks; Atlantic Ocean land.
(a), NopersonshaUconstru'tanystructun,wh atszeverseawardofaUne5Ofeet|andwandofthecrest ofthe
existing dune line; make any excavation, remove any beach material, or otherwise alter existing ground
elevations; drive any motor vehicle on, over or across any sand dune; or darnage or cause to be damaged

landward more than 50feet from the crest ofthe dune, avertical waUsha|behuilt when construction 'is
undertaken within the dune but beyond the setback line pursuant tospecifications approved bythe town
engineer in order to protect the integrity of the dune. Provided, however, nothing herein shall prevent
official motor vehicles of any governmental agency from traversing any sand dune in the performance of
official governmental duties.
(b) In addition to the building setback line of5Ofeet from the dune line, no building orstructure shall be placed
within lOO feet from the mean high-water mark of the Atlantic Ocean, and the greatest distance of the two
measurement standards shall govern. The measurement of the setback line from the dune line and the high-
waterUneshoUbetothec|osestedgeofanybui|ding orstructure tobeerected/constructed onthe Atlantic
Ocean front.
Jund's code is the most robust and the code that we recommend be used as a guide to bolster
our own codes. Please note the protection of existing dunes and the required improvement of
dunes inrelation boredevelopment. Notice also that Juno requires adherence toDEPrules as
well astheir own codes; this isa sensible model for the Village ofTequesta. Here isJumo's
DIVISION 8. COASTAL REGULATIONS
Sec. 34-1l23.Protecton of coastal ridge.
Itisthe intent of this division to maintain and protect the vegetation and structural quality ofthe coastal
dune as. itoccurs inthe town and toprotect rare,,endangered, and threatened plantandanima|specieslocated
along the coast in the town. In addition to the applicable requirements of F.S. ch. 161, and where the town has
jurisdiction, the regulations set forth in this division shall be followed. (Note' all references to the Coastal
Construction Control Lime (CCCL) refer to that line which was established in 1979 and do not pertain to the revised
line, established 1nAugust 2997.)

Sec. 34-1125. Limitations between the CCCL and the town's 50-foot setback west of the L.
(a) LimItations on structures.
(1) Minor structures shall be permitted to be constructed between the Coastal Construction Control Line
(CCCL) and the town's 50-foot setback west of the CCCL after review and approval by the town
planning and zoning department. However, privacy fences shall be allowed only to outline a pool and
deck area and shall extend no further into the 50 foot setback area. Construction of dune walkovers
and other rninor structures shall be in accordance with state department of environmental protection
(DEP) and town standards.
(2) Structures, other than minor structures., shall require review by the planning and zoning board and
approval by the town council. Such review and approva I shall include a balance, between the intent of

this division with other goals, objectives, and policies ofthe comprehensive development plan, such as,
but not limited to, decreasing densities in the coastal area.
(b) Native dune vegetation within the town's50-foot setback west of the OZLshall betrimmed nolower than
five feet above grade. The terms "trimming," "hedging', F1 Picutting," "pruning., IP or any other term used to
identify cutting any part of a sea grape plant shall be regulated by this division. If a petitioning party wishes
totrim below the five-footminimum, the following shall apply:
(z) The petitioner shall obtain and complete an application for trimming native dune vegetationbe|owthe
required f ive-footminimunm.Theapp|iosdonvviUbeprovided bythetown andmay beamendedhnm
time to time by the director of planning and zoning. The applicant will be required to submit, aspart of
the application, a complete evaluation of the subject area proposed for trimming by a qualified
environmental professional as defined herein; and will require an application fee, as well asafee for
any professional review bythe town associated with the application process. The petitioner will be
required to obtain approval from the state department of environmental protection (DEP) prior to
approval from the town.
(2) The bona fide environmental professional shaUbeproficient}naUemvironmenta|aspectsassoc)ated
with the vegetation, trimming of vegetation, the dune, dune system and sea turtles. The town shall
review the credentials ofthe individua|claiming environmental professional status according tothese
disciplines. The applicant will be responsible for consulting with a party that has satisfactorily been
approved by the town under this criteria.
(3) The professional's evaluation shall include consideration of the proposed trimming height; and such
proposed trimming's effect or the vegetation, the dune, the dune system and impacts from the
proposed trimming on the natural sea turtle and other wildlife activities in the area.
(4) Upon evaluation, the professional shall determine whether the impacts will positively or negatively
affect, in anyway, the vegetation, the dune, the dune system and/or natural sea turtle activity.
(5) Said determination shall be made in writing and incorporated into the application/or attached thereto
with anaccompanying recommendation for aspecific height.
(6) The applicant shall be responsible for the tovvn`s fee for a bona fide professional review of said
evaluation, consideration, determination and recommendation. The town's professional shall provide
findings in writing within two weeks of a completely submitted application. Based on these findings the
town may approve, deny orapprove with specific conditions the petition.
(7) Procedures for trimming shall be followed according to figure 3 following this section; or according to
the approved professional recommendations.
(8) Once approval is given for a property,, such property shall be permitted to maintain the sea grapes
according to said approval on a regular basis without further environmental review, however standard
administrative trimming approval must still be obtained and thetom/n's standard administrative form
required every time trimming takes place. Additionally, ifatany time after anapproval isgiven, should
any adverse impacts to the vegetation, the dune, the dune system, sea turtle and other wildlife
activities inthe area bequestioned bythe town, areevaluation ofthe trimmed height effects will be
required. In such a case' the town may require an adjustment not to exceed the tovvn's minimum five-
foot height.
(c) No native dune vegetation within the town's 50-foot setback west of the CCCL shall be removed, except for

Sec. 34-1126. New oceanfront developments or oceanfront redevelopment.
Any new oceanfront development or oceanfront redevelopment shall be required to protect and preserve
existing dune vegetation, except when the town requires the dune to be rebuilt. Dunes shall be required to be
rebuilt and revegetated where they have been destroyed. Historical data and/or nearby properties with existing
dunes shall be used for determination of required dune height. In addition, as part of the development or
redevelopment, areas in need of revegetation eastward of the town's 50-foot setback west of the CCCL shall be
revegetated with appropriate native dune vegetation. During construction activities,. all dune preserve areas which
could be impacted shall be fenced off with screening to prevent any damage to vegetation.

Sec. 34-1127.Sand preservation zone, excavation.
Within the sand preservation zone, all excavated earth material shall be required to beeither relocated on
site and/or disposed of off site preferably in the town or otherwise elsewhere in the county within the sand
preservation zone. The purpose ofthis requirement istomaintain thevo|m/neendqua|ityofbeachsandpresendy
existing within the beach/dune system in the town and the county. An excavation permit shall be required from
the town prior to any excavation in this zone. Prior to permit issuance, the applicant must supply a signed and
sealed letter from a professional engineer stating the amount of material to be excavated and the relocation site.

Sec. 34-1128. Protection of sea turtles.
The town adheres to the county's turtle protection regulations as specified [n article 14, chapter A of Palm
Beach County's Unified Land Development Code, excluding, however, those provisions regarding -sand
preservation. No building permit or certificate of occupancy shall be issued until all requirements of the county's
turtle protection regulations have been met.

Sec. 34-1131. Emergencies and exemptions.
(a) In the case of emergencies, for example, those caused by hurricanes, severe stormsj, or other similar events,,
the town manager may make exceptions to the regulations in this division, in consultation with DEP if
required, to protect t h e health, safety, a nd we I f a re of town residents a n d vis ito rs.
Exemptions to these regulations may be granted by town staff when the regulations established in this
division conflict with other gove r n me nta I agency re q u i rem e nts, or when minor rn od ifii cati ons to existing

the dune or other purposes of this division.

All exterior lighting for the buildings and parking areas shall be directed away from residential areas,
