PLANNING AND ZONING BOARD MEETING
VILLAGE OF TEQUESTA, FL
FEBRUARY 17, 2022 5:30 PM COUNCIL CHAMBERS
CALL TO ORDER AND ROLL CALL
The meeting was called to order by Board Chair, Janet Strand at 5:30 p.m. A roll call was taken
by Community Development Planner, Lance Lilly. Present were: Board Chair, Janet Strand, Vice
Chair Steven Eagen, Board Members Elizabeth Schauer, James Hackett, Theresa Maggio,
Jeanne McEldowney. Board Member Leslee Dasher and Sherry Ambrose were absent. Also
present were Village Attorney, Matthew Pritchett and Community Development Director, Nilsa
Zacarias.
APPROVAL OF AGENDA
MOTION: Member Schauer made a motion to approve the agenda. Member Maggio seconded the
motion. Carried unanimously 5-0.
APPROVAL OF MINUTES
MOTION: Vice Chair Eagen made a motion to approve the previous meeting minutes of December
16, 2021. Member Maggio seconded the motion. Carried unanimously 5-0.
AGENDA ITEMS
1. SPM 1-22: Application from GALLERY SQUARE SOUTH LLC for a site plan
modification to install a six (6) foot high dumpster enclosure with 112 square foot
concrete slab in the parking area per Sec. 78-300. The subject property is located at
384 Tequesta Drive, Tequesta, Florida 33469.
Village Attorney, Matthew Pritchett announced the quasi-judicial nature of the item and
swore in the applicant, Louis Gugliotta. Mr. Hackett and Ms. Maggio disclosed they
conducted a site visit of the property. The other Board Members disclosed that there was
no ex-parte communication.
Member Schauer questioned what took the applicant so long in requesting a dumpster for
the shopping plaza.
Member Hackett questioned how close the proposed dumpster enclosure would be to the
existing residence to the east. Director Zacarias explained that code does not specify the
setback for dumpster from adjacent residences. Member Hackett questioned why the
applicant did not consider an alternative location on the property for the dumpster. Mr.
Gugliotta explained that other locations were considered and since the property exceeds
the number of required parking spaces and that Waste Management approved the location
for waste pick up collection this location was finally selected. Member Hackett believed the
dumpster should be relocated elsewhere on the site due to the additional noise and smell
associated to a dumpster.
Member Hackett voiced his concerns for the current special exception and site plan
modification process. Mr. Gugliotta explained that letters were sent to the neighbors within
a 300-foot radius of the property. Director Zacarias continued that there was the Village
Council heard a Special Exception Use for the modification of the shopping center, and
there were no objections from the residents that received the letter. Also, the Village
Council approved the Special Exception Use application.
Vice Chair Eagen agreed with Member Hackett that he believed the dumpster should be
relocated elsewhere on the property and that it may be too close to the adjacent neighbor.
Jeanne McEldowney, 275 Beach Road, stated she saw the images of the current trash
situation in the staff report and questioned whether the neighbors of the property may think
the dumpsters are an improvement. Member Hackett stated when he made a site visit; he
saw various containers but did not see any trash at the time. Mr. Gugliotta stated that trash
is collected twice a week and Member Hackett might have come at the right time of the
week.
MOTION: Member Schauer made a motion to approve SPM 1-22. Member Maggio
seconded the motion. Carried 3-2.

There were no Staff comments.
PUBLIC COMMENTS
There were no Public comments.
BOARD COMMENTS
Member Schauer questioned if the Village was planning to address fences along Riverside Drive.
Director Zacarias explained that Community Development has compiled a list of code revisions
for the Village and has already added the proposed fence revision to the list.
Member Hackett requested staff look into a code provision for a setback requirement for
dumpsters adjacent to residential properties.
ADJOURNMENT
MOTION: Member Schauer made a motion to adjourn at 5:59 pm. Member Maggio seconded
the motion. Carried unanimously 5-0.
