Subject.* Environmental Advisory Committee (EAC) Activities 2021/2022 Report
This memorandum addresses the most recent activities of the VOT EAC. Also, for reference, this
memo includes attachments pertaining to the EAC activities for prior years. This helps to pinpoint
trends that may exist in the Committee's focus over time.
At the request of then Mayor Abby Brennan, the EAC was formed in the summer of 2019 by the
unanimous adoption of Village Council Resolution No. 21-19, a copy of which is attached to this
memorandum. Section 3 of the resolution calls for the EA C to, "...hold public meetings .fog- the
purpose qfdeveloping recommendationsfior best practices,.fostering community partnerships, and
within the bounds of the Village's Comprehensive Development Plan, developing
recommendations for goals, objectiveand policies relative to sustaining and improving the

Tequesta is the northernmost municipality in Palm Beach County consisting of a population of
approximately 6,200 persons residing on three peninsulas surrounded on three sides by the waters
of the Atlantic Ocean, the Intracoastal Waterway, or the Loxahatchee River and its North and
Northwest forks which was designated a National Wild and Scenic River in 1985 (the first in
Florida). To Tequesta's north and on its doorstep lies Jonathan Dickinson State Park consisting of
11,50o acres. Being a waterfront communi ty, Tequesta is susceptible to storm surge from tropical

cyclones and sea level rise. To protect our valuable lands and the natural environment that
surrouiids us it is incumbent upon us as proper stewards of our lands, the air we breathe and our
waters to do all things reasonably possible to stabilize and enhance the overall health of our local

To this end, the VOT EAC has worked hard now for a number of years to improve the local
environment by making numerous recommendations to the Village Council and staff. The work
that is deemed most important is inherently subjective, but for this author the following are actions
and recommendations that are noteworthy for 2021/2022:
o In 2022, the Village formalized a process whereby any recommendations of the EAC will
be vetted by the Village Council on at least a quarterly basis as needed at a workshop
meeting of the Village Council.
o The EAC developed a Race to Zero like plan for Tequesta as requested by the Village
Manager wherein we recommended membership in ICLE1 USA (Local Governments for
Sustainability) to gain access to the GHG inventory process provided by ICLEI using its
ClearPath tool. This was approved by the Village Manager and work is underway by
Village staff and will shortly be made available.
o The EAC completed the review and recommendations for the Conservation Element of the
Comprehensive Plan which consisted of 115 goals, objectives and policies related to
environmental matters. In addition, the Recreation and Open Space Element has been
initiated and will be finished on September 14. This leaves three Elements to be reviewed
by the EAC for the first time and three needing to have a quick second look using the
enhanced process we have developed over time.
o Although the Village may not have been aware of the details of our work on the
Conservation Element of the Coniprehensive Plan, we have recommended there and in

other places in the Comprehensive Plan that Tequesta undertake a Vulnerability Study to
gauge the location of any problem areas for public property, private property and public
infrastructure. A vulnerability study is the first step in the process of taking corrective
actions that may be needed to address anticipated problems from rising sea levels. We were
pleased to learn that Tequesta was pursuing a state grant for such work and first considered
a contract to undertake the work at the Village Council meeting in August 2022.
o Nilsa Zacarlas, Director of Community Development, Village of Tequesta, met with the
EAC to review the Village's park planning process. Ms. Zacarlas ultimately modified
draft plans for Tequesta Park and Remembrance Park on a number of park design
elements recommended by the E.Q.C.
o The EAC continued to find places to update the Code for maximizing the use of Florida
Friendly Landscaping.
o The E. made recommendations for the EAC to review new development proposals as
is done by the Planning and Zoning Board in the Town of Juno Beach. This resulted in
the Director of Community Development receiving permission to use an environmental
consultant in the Development Review Committee (DRQ process as may be necessary
from time to time.
o In February we resurrected the Trees for Tequesta concept that was originally brought
forward by the EAC in June of 2021 as a way to raise funds to plant trees to expand the
Tequesta tree canopies on more roadways in Tequesta. The VOT has recently implemented
an Adopt a Tree Program where free trees are provided to property owners who agree to
maintain them. This is a low cost means of reducing greenhouse gases (GHG) while
providing shade to facilitate walking and bicycling, natural habitat and increasing property
values.
o We received an important presentation from Laura Tellez, South Florida Program
Coordinator., Solar United Neighbors of Florida. Presentation on: Issues and Policies
Impacting Your Ability to Go Solar in Florida which was beneficial to the EAC and the
public as we seek to expand the use of clean energy use per Policy 1.3.6 the Housing
Element of the VOT Comprehensive Plan.
o We recommended that the Village join the Town of Palm Beach Push for the Right to
Regulate Pesticide Use to help reduce chemicals in our environment which end up in our
waterways etc.
o The EAC scrutinized the Florida Resource Management Plan Amendment for the Jupiter
Inlet Lighthouse Outstanding Natural Area. Most concerns were external to the lands
within Tequesta.
o The EAC was requested by the V1 I lage Manager to make recommendations for the existing
street tree canopy and for the locations for the expansion of the tree canopy to other streets
providing vehicular access in Tequesta. Existing location recommendations are scheduled
for EAC recommendations on September 14 and expansion areas no later than October 12.

2021 started out very slowly for the EAC because of the impacts from Covid-19. Based upon my
records, there were no EAC meetings in November and December in 2020 and not in January 2021
as well. The first EAC meeting of 2021 was in February. A listing of 2021 activities of the EAC
appears below.

' The EAC wrote the draft ordinance on fertilizer regulations. Ordinance 1-21 was adopted by the Village Council
on March 11, 2021.

written comments before the Florida Fish & Wildlife Conservation Commission urging passage which was
approved, but is being contested special interests.
' The resolution creating the EAC requires the EAC to review the VOT Comprehensive Plan for all matters
pertaining to the environment and make recommendations to the Village on environmental goals, objectives and
policies. This is an ongoing process. One will see numerous references to such work throughout this document.

Model 3s as service vehicles in the VOT using FOOT funding during the US I Bridge construction project. No

The EAC found discrepancies m the VCR' Code as it relates to pesticides. The EAC made recommendations to
VOT to update the applicable section of the Code. See adopted VC T Ordinance No. 8-2 1.

Florida requires golf courses to follow Best Practices Guidelines in the use of fertilizers and pesticides. A number
of concerns were raised about the Tequesta Country Club practices and their management of local stormwater runoff
which is managed in part by the water hazards on the golf course. The EAC requested the TCC to come and tell the
EAC about their use of Florida's required Best Practices Guidelines. TCC did not respond to our request.

The Village Council requested the EAC to develop a recycling education/informational program to encourage
increased participation in Tequesta. Our research and discussions with SWA revealed it was best to use the SWA
ongoing infori-nation/education program in all VOT communications platforms. The SWA is also willing to make a
presentation to the EAC on recycling and this can be advertised in advance to facilitate public participation.

The LAC wants the tree canopy in VOT expanded. Trees for Tequesta is a program where the public a [so makes
donations for trees in right-of-way and on public real property. The E. plan is to start the process with the
development of Remembrance Park, and with success there, expand the program to the barren areas on public
property in need of trees that VOT may not be able to afford.
I I The EAC made the VO T staff aware of the FPL " fre e " charging stations program and the contact personnel at
FPL overseeing the program. We even provided preferred locations Per FPL stated preferences. FPL declined to
install in Tequesta. The EAC provided alternatives for charging stations at the new Recreation Center most likely on
Dover Road. One option is turn key with everything provided by and managed by the charging station manufacturer.
VOT staff has not taken steps to implement a public charging station option in Tequesta to date.
" The Village Council requested the EAC to make a recommendation to them whether or not to support the Loxa-
Lucie Headwaters Initiative. After deliberations and a presentation from Geraldine Dube the EAC recommended
supporting the efforts of the Loxa-Lucle Headwaters Initiative. The Village Council approved doing so and writing a
letter to that effect.
" The Village Manager asked the EAC find a low-cost way VOT could being to be proactive in curtailing
greenhouse gas (GHG) emissions. Step I is to quantify one's carbon footprint and to quantify the effect of
mitigation steps to curtail VOT GHG. The EA C recommended to the Village Manager that the VDT join ICLEI
USA which is low cost and crives us access to their proprietary program called ClearPath to quantify GHG and the
impact of GHG mitigation efforts. The Village Manager agreed and the VOT is now a member of ICLEI and a staff
member has been assigned the task to working with ICLEI and the EAC.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA.5 FLORIDA, PROVIDING FOR A VILLAGE OF TEQUESTA
ENVIRONMENTAL COMMITTEE; PROVIDING FOR COMMITTEE
COMPOSITION., AUTHORITY & RESPONSIBILlTIES- PROVIDING FOR
COMPLIANCE WITH LAWS; PROVIDING FOR SLJNSET OF SAID
COMMITTEE- PROVIDING AN FFFECTIVELATE; AND FOR OTHER
PURPOSES.
WHEREAS, the Village of Tequesta is a waterfront community which both benefits from.,
and impacts, coastal and inland waterways; and
WHEREAS, the Village of Tequesta is home to a variety of natural and park areas, including
a fully developed golf course a natural preserve area and all manner of parklands in between- and
WHEREAS, the wellbeing of all these natural and public resources, as well as the general
wellbeing of all residential and commercial landscaped areas and vegetation areas is of great
importance to the Village Council; and
WHEREAS, negative impacts on the Villages environment and its natural and public
resources can come from sources from within and from outside of the Village and with proper
education and regulation may be controlled or mitigated; and
WHEREAS in an effort to preserve and protect all of the Village's environmental resources
and amenities, the Village Council of the Village of Tequesta, Florida, now desires to provide for a
"Village of Tequesta Environmental Committee"'; and
WHEREAS, the Village Council desires to provide for the committee's composition, its
authority & responsibilities, and for its compliance with applicable laws; and
WHEREAS, the Village Council desires to provide for the sunset of the committee.
NOW., THEREFORE., BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTAq PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The above stated recitals arc truc and accurate and are hereby made part of
this Resolutions.
Section 2: The Village Council of the Village of'l"equesta, Florida, hereby provides for
the "Village of Tequesta Environmental Committee". The Village of Tequesta Environmental
Committee shall be composed of up to seven (7) members. The initial members of the Village of
Tequesta Environmental Committee, appointed by the Village Council in conjunction with the

estabilshment of the committee, are as follows:

Conunittee members shall serve at the pleasure of the Village Council until they are removed by the
Village Council, or until they voluntarily resign their seat, or until the committee is dissolved
pursuant to Section 5 of this resolution. Vacancies may be filled via appointment by the Village
Council from time to time.
Section 3: The Village of Tequesta Environmental Clointni ttee shall hold pub li c meetings
for the purp o s e ofdeveloping re commendations for best practices, fostering c olm-nun ity partnerships,
and within the bounds of the Village's Comprehensive Development Plan, developing
recommendations for goals, objectives and policies relative to sustaining and improving the
environment of the Village of Tequesta. The Village of Te.questa Environmental. Committee shall
report to the Village Council from time to time and shall present its recommendations to the Village
Counei I for further direction, final review and ultimate approval.
Section 4: The Village of Tequesta Environmental Committee shall appoint from among
its -membership a Chair and a Vice -Chair, and shall establish its own rules of procedure; however
any such rules shall comply with and be subject to the Florida Government in the Sunshine laws and
the Florida Public Records Act. Additionally, all committee members shall be bound by the Florida
Code of Ethics and the Palm Beach County Code of Ethics for appointed officials.
Section 5: The Village of Tequesta Environmental Committee shall continue until such
time as the Village Council shall by resolution deem the committee to no longer be required and
dissolve same.
Section 6: This Resolution shall take effect immediately upon adoption.
