RESOLUTION NO. 34-22, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, CONFIRMING BY PROCLAMATION THE STATE OF EMERGENCY
DECLARATION ISSUED ON SEPTEMBER 27, 2022 AT 4:10 PM FOR THE VILLAGE OF TEQUESTA
DUE TO HURRICANE IAN, ALL EMERGENCY REGULATIONS ACTIVATED UNDER THE
PROVISIONS OF CHAPTER 26 OF THE VILLAGE CODE OF ORDINANCES, AND THE
DESIGNATION OF THE FIRE CHIEF AS THE EMERGENCY MANAGEMENT DIRECTOR FOR THE
VILLAGE FOR SO LONG AS THE LOCAL STATE OF EMERGENCY CONTINUES IN EFFECT,
PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
On September 27, 2022 at 4:10 pm, Mayor Young, Manager Allen and Fire Chief Trube declared a
State of Emergency in the Village of Tequesta. Per Village Charter Sec. 26-5(b), "Any declaration of a
local state of emergency and all emergency regulations activated under the provisions of this article
shall be confirmed by the village council by proclamation no later than its next regularly scheduled
meeting, unless the nature of the emergency renders a meeting of the village council impractical."
This resolution effectuates that confirmation.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, CONFIRMING BY PROCLAMATION THE
STATE OF EMERGENCY DECLARATION ISSUED ON SEPTEMBER

UNDER THE PROVISIONS OF CHAPTER 26 OF THE VILLAGE CODE
OF ORDINANCES, AND THE DESIGNATION OF THE FIRE CHIEF AS
THE EMERGENCY MANAGEMENT DIRECTOR FOR THE VILLAGE
FOR SO LONG AS THE LOCAL STATE OF EMERGENCY CONTINUES
IN EFFECT, PROVIDING FOR SEVERABILITY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, Hurricane Ian was a major hurricane traveling north-east through the
Gulf of Mexico; and
WHEREAS, due to the landfall of Hurricane Ian, severe weather, was expected,
including flooding, high winds and downed debris; and
WHEREAS, Hurricane Ian was expected to produce excessive rainfall, damaging
winds, and tornados causing flooding, fallen trees and power lines necessitating the
closure of the Village of Tequesta, and
WHEREAS, the assistance of the local government is necessary in order to
protect the public health, preserve the safety of the public, keep property damage to a
minimum and restore the social and economic welfare of our Village and its residents
and visitors; and
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1 As designated by Section 26-5 of the Village Code of Ordinances,
the Mayor (Mayor Molly Young), Village Manager (Jeremy Allen) and Emergency
Management Director (Fire Chief Trube) issued a State of Emergency Declaration on
Tuesday, September 27, 2022, for the Village due to Hurricane Ian.
Section 2 Section 26-3 of the Village Code of Ordinances designates the Fire
Chief as the Emergency Management Director in order to accomplish all coordination,
direction and implementation of all disaster management functions.
Section 3 Pursuant to Section 26-5 of the Village Code of Ordinances, the
Village Council of the Village of Tequesta hereby confirms by Proclamation the State of
Emergency Declaration issued on September 27, 2022 for the Village of Tequesta due

to Hurricane Ian, all emergency regulations activated under the provisions of Chapter 26
of the Village Code of Ordinances, and the designation of the Fire Chief as the
Emergency Management Director for the Village for so long as the local state of
emergency continues in effect.
Section 4 This Resolution shall become effective immediately upon passage.

Please be advised that We, Mayor Molly Young, Village Manager Jeremy Allen, and
Director of Emergency Management James Trube, do hereby declare on September 27, 2022 at
4:10 PM that a state of emergency exists within the corporate UrniLs of the Village ofTequesta in
accordance with Chapter 26 Article I of the Village Code of Ordinances, and Chapter 252, Florida
Statutes due to the impending landfall of Hurricane Ian, which is expected to bring severe
weather, including flooding, high winds and downed debris.
We further declare that the various Village officers, officials and/or employees to whom
we have delegated responsibility for various assignments in order to carry out this Declaration of
Emergency are directed to exercise all emergency powers conferred under ChapterZ5Z, Florida
Statutes as we so direct as well as any other powers that may be necessary to protect the
municipality from any and all threats to public peace and order or to the general welfare and/or
to protect all property and persons in the Village ofTequesta, as we deem necessary.

Sec. 26-5. - Declaration of a state of emergency.
(a) The director of emergency management, the mayor and the village manager acting
in concert, or any two of them if one is not available, or any one of them if neither of
the other two are available shall have the authority to declare a local state of
emergency.
(b) Any declaration of a local state of emergency and all emergency regulations activated
under the provisions of this article shall be confirmed by the village council by
proclamation no later than its next regularly scheduled meeting, unless the nature of
the emergency renders a meeting of the village council impractical.
(c) An emergency declaration authorized under this Article shall authorize temporary
emergency measures necessary for the protection of the public health, safety and
welfare, which shall, if applicable, be coordinated with activities of the Palm Beach
County Emergency Management Agency, and may include but is not limited to the
following subjects:
(1) Evacuations;
(2) Curfews and declaration of areas off limits;
(3) Suspension or regulation of the sale of, or offer to sell, with or without
consideration: alcoholic beverages, explosives, or combustibles;
(4) Suspension of local building regulations;
(5) Emergency procurement procedures, and the appropriation and expenditure of
public funds;
(6) Regulating the use of and rationing of fuel, ice and other essentials.
(7) Providing for the health and safety of persons and property;
(8) Any other subject as authorized by F.S. Ch. 252.
(d) A local state of emergency, when declared as provided herein, shall continue in effect
for no longer than 60 days without being affirmatively renewed, and may be
terminated at any time.
(e) Upon the declaration of a state of emergency under this article, a written notice of
such declaration shall be posted on the bulletin board at Village Hall, and as promptly
as practical, said notice shall be filed in the office of the village clerk, and delivered to
local news media for publication and radio and television broadcast.

The Village of Tequesta was under a Local State of Emergency which was enacted
on September 27, 2022 at 1610 hours;
The Village of Tequesta is no longer feeling the significant effects of Hurricane
Ian and this All- Clear is being issued. The latest damage assessment reports no
significant damage, minimal amount of debris, and minor flooding;
Additionally, the Palm Beach County EOC advises that the tornado watch has
been lifted. The flood advisory has ended as of 1800. The Tequesta EOC has
downgraded to level 3 monitoring as this storm passes north of our area;
BE ADVISED as of 1930 hours on September 28, 2022, the Village of Tequesta is
no longer operating under a State of Emergency.
