Workshop STAFF MEMO Meeting: Workshop - Nov 01 2022 Staff Contact: Nilsa Zacarias, Director of Community Development Discuss Conceptual Site Plan Process AL Department: Community Development To: Mayor Molly Young and Village Council From: Nilsa Zacarias, AICP, Community Development Director Date: November 1, 2022 Ref.: Discussion on Conceptual Site Plan Applications In 2014, the Village Council adopted Ordinance #42-13, allowing conceptual presentations. Per Village Code Section 78-332 (b) (1), "the applicant may request to present his conceptual site plan to the village council in order to receive further input." The existing code does Not require the review of conceptual presentations by Village Staff, and the subject application is not required to be compliant with the Village Code. Currently, applicants must provide the following when submitting an application for conceptual presentation: • Sketches and diagrams to convey the conceptual site plan, which may include site plans, floor plans and/or surveys • Brief explanation that the proposed site plan complies with village code, including aesthetic considerations Based on recent development applications, Staff is considering mandating conceptual presentations for new development or redevelopment of parcels located along the US Highway 1, Tequesta Drive, and Beach Road Corridors, that meet any of the following criteria: 1. New developments on vacant sites. 2. An existing building or buildings proposed to be removed, and replaced with a new building or buildings. 3. Significant changes or alterations to an existing building's aesthetics. 4. Any proposed increase or reduction in: a. Building square footage; b. density; c. the number of structures; d. the number of residential dwelling units in a residential or mixed -use zoning district; e. height and stories of any building. The conceptual presentation application shall include drawings that provide the following tabular data, which will be reviewed by Village Staff for compliance with the zoning code: Proposed height and number of stories Proposed density and number of units Proposed open space and lot coverage percentages Page 3 of 156 Agenda Item #1. The intent of this code amendment is to provide the Village Council with a preliminary review of conceptual site plans by the Village Staff. However, the conceptual plan review is not intended to be a complete site plan review that requires detailed review by the Development Review Committee (DRC) and numerous code compliance items. The current application fee for conceptual presentations is $300.00. Based on these changes and review for compliance with the Village code, Staff is proposing an increase of the current $300.00 application fee to $500.00. Enclosed: 1. Conceptual Presentation to Council Conceptual Presentation Application Proposed Page 4 of 156 Agenda Item #1. Sec. 78-332. Pre -application meeting; optional pre -application review process. (a) A pre -application meeting called by the community development director between appropriate village officials, the landowner or representative, and other entity representatives deemed appropriate shall be required prior to application submittal for site plan review to ensure proper coordination, intention and understanding in the development of land and buildings and to consider compliance with applicable village regulations. See section 78-331(g) for a list of possible pre -application meeting attendees. The applicant is responsible for properly notifying the various affected agencies in the list of the time, place and subject of the pre -application meeting. (b) Prior to submitting a site plan review application and committing the resources required to proceed through the site plan review application process as required by section 78-334, an applicant may choose to participate in the following pre -application process in order to gauge interest in his proposed project. (1) Conceptual presentation. Based on the outcome of the pre -application meeting, the applicant may request to present his conceptual site plan to the village council in order to receive further input. This conceptual presentation is not a quasi-judicial proceeding, and no action shall be taken by the village council beyond discussion with the applicant. Neither the outcome of this conceptual presentation, nor any comments made during this conceptual presentation by any village council member or village staff is a guarantee or assurance in any way of the final action that may be taken by the village council pursuant to a formal application for site plan review as provided in section 78-334. (2) Prior to being placed on a village council agenda for a conceptual presentation, the applicant shall submit the following: a. Processing fee in an amount as established by resolution of the village council and on file in the village clerk's office. b. Seven copies of sketches and diagrams sufficient to convey the conceptual site plan to the village council. This may include site plans, floor plans and/or surveys. C. Seven copies of a brief explanation that the proposed site plan complies with village code, including aesthetic considerations. (Ord.
