A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, CONFIRMING BY PROCLAMATION THE
STATE OF EMERGENCY DECLARATION ISSUED ON NOVEMBER 9,
2022 AT 8:00 AM FOR THE VILLAGE OF TEQUESTA DUE TO
HURRICANE NICOLE, ALL EMERGENCY REGULATIONS ACTIVATED
UNDER THE PROVISIONS OF CHAPTER 26 OF THE VILLAGE CODE
OF ORDINANCES, AND THE DESIGNATION OF THE FIRE CHIEF AS
THE EMERGENCY MANAGEMENT DIRECTOR FOR THE VILLAGE
FOR SO LONG AS THE LOCAL STATE OF EMERGENCY CONTINUES
IN EFFECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, on November 9, 2022, Hurricane Nicole was a tropical storm
anticipated to intensify to a Category 1 hurricane traveling WSW near 13 mph with a
turn to the west toward northern Palm Beach County and Martin County; and
WHEREAS, due to the anticipated landfall of Hurricane Nicole in northern palm
Beach County and Martin County, severe weather was expected, including significant
rainfall, flooding, storm surge, high winds and downed debris; and
WHEREAS, on November 8, 2022, Palm Beach County Emergency
Management issued a mandatory evacuation for Zones A and B which includes most of
the Village of Tequesta (from beach to approximately Country Club Drive); and
WHEREAS, Hurricane Nicole was expected to produce excessive rainfall,
damaging winds, and tornados causing flooding, fallen trees and power lines
necessitating the closure of the Village of Tequesta beginning November 9, 2022, and
WHEREAS, the assistance of the local government is necessary in order to
protect the public health, preserve the safety of the public, keep property damage to a
minimum and restore the social and economic welfare of our Village and its residents
and visitors, necessitating the declaration of a local state of emergency which activates
certain emergency governmental operational responses.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1 As designated by Section 26-5 of the Village Code of Ordinances,
the Mayor (Mayor Molly Young), Village Manager (Jeremy Allen) and Emergency
Management Director (Fire Chief Trube) issued a State of Emergency Declaration on
Wednesday, November 9, 2022, for the Village of Tequesta due to the impact of
Hurricane Nicole.
Section 2 Section 26-3 of the Village Code of Ordinances designates the Fire
Chief as the Emergency Management Director in order to accomplish all coordination,
direction and implementation of all disaster management functions.
Section 3 Pursuant to Section 26-5 of the Village Code of Ordinances, the
Village Council of the Village of Tequesta hereby confirms by Proclamation the State of
Emergency Declaration issued on November 9, 2022 for the Village of Tequesta due to
Hurricane Nicole, all emergency regulations activated under the provisions of Chapter
26 of the Village Code of Ordinances, and the designation of the Fire Chief as the
Emergency Management Director for the Village for so long as the local state of
emergency continues in effect.
Section 4 This Resolution shall become effective immediately upon passage.

"Notice of Declared State of Emergency"
Please be advised that We, Mayor Molly Young, Village Manager Jeremy Allen, and
Director of Emergency Management James Trube, do hereby declare on November 9, 2022 at
8:00am that a state of emergency exists within the corporate limits of the Village of Tequesta in
accordance with Chapter 26 Article I of the Village Code of Ordinances, and Chapter 252, Florida
Statutes due to the impending landfall of Hurricane Ian, which is expected to bring severe
weather, including flooding, high winds and downed debris.
We further declare that the various Village officers, officials and/or employees to whom
we have delegated responsibility for various assignments in order to carry out this Declaration of
Emergency are directed to exercise all emergency powers conferred under Chapter 252, Florida
Statutes as we so direct as well as any other powers that may be necessary to protect the
municipality from any and all threats to public peace and order or to the general welfare and/or
to protect all property and persons in the Village of Tequesta, as we deem necessary.

SUBJECT: Hurricane Nicole—All-Clear
The Village of Tequesta was under a Local State of Emergency which was enacted on
November 9, 2022 at 0800 hours;
The Village of Tequesta is no longer feeling any significant effects of Hurricane Nicole
and this All-Clear is being issued. The latest damage assessment reports no significant
damage and minimal amount of debris,
BE ADVISED as of 0730 hours on November 10, 2022, the Village of Tequesta EOC is
demobilizing and no longer operating under a State of Emergency.
