Consider Approval of Sports Tyme Inc. Facility Use Agreement for the 2023 Summer Camp at the
Tequesta Recreation Center
SUMMARY
Consider attached Sports Tyme Inc. Facility Use Agreement for the 2023 summer camp at the Tequesta
Recreation Center. Sports Tyme Inc. will pay a weekly fee of $2130 ($2,000 plus 6% sales tax), totaling
$21,300-00 for 10 weeks, commencing May 30, 2023 and ending on August 4, 2023. Campers will be
5-13 years old and the camp will run from 8 am-5:30 pm. All coaches are fingerprinted and background
checked, as well as CPR certified. Sports Tyme Inc. used the Tequesta Recreation Center for their
summer camp last summer as well.

VILLAGE OF TEQUESTA PARKS AND RECREATION DEPARTMENT
FACILITY USE AGREEMENT
THIS AGREEMENT FOR use of the Village of Tequesta Rec Center
Gymnasium and Constitution Park ("Agreement") is entered into and effective this
day of 15 20 (the "Effective Date"), by and betweeii the V T L L A G E OF
TEQUESTA, a Florida municipal corporation with offices located at 345 Tequesta Drive,
Tequesta, Florida 33469, organized and existing in accordance with the laws of the State of Florida,
hereinafter the "Village"; and C-1 . with offices located at

collectively with the Village, the ``Parties".
WITNESSETH
The Village and the Renter, in consideration of the mutual covenants contained herein and
for other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged by both Parties, hereby agree as follows:
1. FACILITY INFORMATION AND FEES: The Parties hereby agree to enter into this
Agreement whereby the Village will allow Renter to occupy certain areas in the Village Rec Center
Gymnasium and Constitution Park as further described below., for the purposes of operating a
Summer Camp -type program. The Facility is located at 399 Seabrook Road,, Tequesta, FL 313469

("Facility"). Renter agrees to pay the weekly fee of $ for Facility use during
session operations, totaling $ ;�I_i 300. 00 for 10 weeks ("Fee"). Renter agrees to make
payments to the Village by check, with half of the Fee due prior to the first day of facility use, and
the other half due on the Monday of the last week of the camp program. If Facility space is needed
I'm- traininb or orientation dates for staff, that will be covered by a separate agreement.
2. USE OF FACILITY: The Facility shall be used for the purpose stated in the Agreement
and as further described in the Renter's proposal, attached as Exhibit "A." Renter shall comply
with all local, (U
state, and federal laws related to its program and use of the Facility. The yninasium
is a secure location in the building and requires a key fob to enter. Only Village staff have access

to opening the secured doors. The areas of the Facility that are off limits to the Renter are: the
game room, kitchenette, offices, lobby slide, and activity rooms 1, 2, & 5. In the event that the
playground is used, Renter must follow a "Playground Supervision Plan" which will be attached
to this Agreement as Exhibit ``B."
6B.191 people is the maxiMUni building occupancy for
the gymnasium. Due to fire codes, the Renter shall not exceed this number. It is the responsibility
of the Renter to provide adequate supervision to the youth during organized and unorganized
activities. Any use of Constitution Park Must be appropriately monitored by the Renter and its
staff. Restrooms must be appropriately monitored by the Renter and its staff when in use by the
youth. Alcohol, gum, vaping, and tobacco products are prop ibitcd in the park or in the Facility.
Renter shall not store any equipment or materials at the facility without approval of the Recreation
Supervisor. Renter shall not remove, relocate, or take Village property outside for any reason
without approval from the Recreation Supervisor. Renter is responsible for cleanup of the facility.
Renter shall pick up, bag, and remove all trash generated inside the facility. Renter Must sweep
the gymnasium floor daily. It is the responsibility of the Renter to keep, collect and store any
items, known as "lost and found," that are left behind by the youth attending its program. Renter
wi
ll leave all fixtures in the condition that they were fOLInd in or be charged for any damages. Any
and all damage in the park or inside the facility must be reported to the Recreation Supervisor in
writing to kworley@tequesta.org as soon as it is noted. Failure to do so will be conclusive evidence
that the damage was caused through the fault of the Renter. In the event there is any damage to
the facility equipment, l'urniture, or park equipment, through the fault of the Renter, its staff., or
youth attending its program, the Renter shall pay all fees to cover the costs of repair.
3. CAMP RULES., REGULATIONS., AND TRAININGS: All Renter's camp staff
("Camp Staff') are required to pass a level 2 background check. Any Camp Staff that fail said
background check are prohibited from working at the Facility under this Agreement. A list or
description of all staff qualifications., trainings, and prescreening is attached as Exhibit 4.4c. A
description of camp rules and regulations will be provided to the Village Recreation Supervisor.
At all times Renter will ensure these rules and regulations are followed. Renter agrees to provide
Village residents priority registration, including early registration and reduced cost registration.
Camp attendees will be dropped off and picked up in a car line style. Camp Staff will be
responsible for the security and safety of the youth at all times during this process and must have
a staffm em ber available to walk the youth into the building at drop off time. Parents are prohibited

from entering the Facility at this time, and it is the responsibility of the Camp Staff to enforce this
rule. All Camp Staff will park M the parking lot across the street from the Facility on Seabrook
Road.
4. TERM; TERMINATION; NOTICE: ']'his Agreement shall be for a term of

This Agreement may be terminated without cause by either party upon 60 days written notice to
the other party. This Agreement may be terminated for cause for (i} either party"s ft-11IL11-e to COMPly

by the other party in this Agreement or any of its exhibits proving to have been incorrect or false
in any material respect when made. In the event that either party wishes to terminate this
Agreement for cause, that party must give the other party written notice of the alleged cause for
termination and seven (7_) days„ to cure the alleged cause for termination.

5. INSURANCE: The Renter shall provide proof of workman" s compensation insurance and
liability insurance ill Such amounts as deemed sufficient by the Village and shall name the Vi page
as an "additional insured" on the liability portion of the insurance policy.
6. INDEMNIFICATION: The Renter shall at all times indemnify, defend and hold harmless
the Village, its agents,, servants, and employees, from and against any claim, demand or cause of
action of whatsoever kind or nature, arising out of error, omission, negligent act, conduct, or
misconduct of the Renter, its agents, servants, or employees in the performance of services under
this Agreement. Nothing contained in this provision shall be construed or interpreted as consent
by the Village to be sued, nor as a waiver of sovereign immunity beyond the waiver provided in
Section 768.28, Florida Statutes.
7. RELATIONSHIP OF THE PARTIES: It is specifically understood that the Renter is
not all agent or employee of the Village. Both the Village and the Renter agree that this Agreement

is not a contract for employment and that no relationship ofernployee—employcr or principal —
agent is or shall be created hereby, nor shall hereafter exist by reason of this Agreement.
S. AMENDMENTS AN D ASSIGNMENTS: This Agreement and all Exhibits attached
hereto constitute the entire Agreement between both Parties; no modifications shall be made to
this Agreement unless in writing, agreed to by both Parties, and attached hereto as an addendum
to this Agreement. The Renter shall under no circumstances sublease the Facility or allow any
other organization or individual LISC of the 1--acility withOLIt prior written consent of the Village.
9. ATTORNEY'S FEES: In the event a dispute arises concerning this Agreement, the
prevailing party shall be awarded attorney's fees, including fees on appeal.
10. CHOICE OF LAW; VENUE: This Agreement shall be governed and construed in
accordance with the laws of the State of Florida, and venue shall be in Palm Beach County should
any dispute arise with regard to this Agreement.
11. PUBLIC RECORDS: In accordance with Section 1 19.07015 Florida Statutes, the Renter
must keep and maintain this Agreement and any other records associated therewith and that are
associated with the performance of the work described in Scope of Services. Upon request from
the Village's custodian of public records, the Renter must provide the Village with copies of
requested records, or allow such records to be inspected or copied, within a reasonable time in
accordance with access and cost requirements of Chapter 119, Florida Statutes. A Renter who fails
to provide the public records to the Village, or fails to make them available for inspection or
copying, within a reasonable time may be subject to attorney's fees and costs pursuant to Section
1 19.0701, Florida Statutes, and other penalties under Section 119. 10, Florida Statutes. Further,
the Renter shall ensure that any exempt or confidential records associated with this Agreement or
associated with the provision of services contemplated herein are not disclosed except as
authorized by law for the duration of the Agreement term, and following completion of the
Agreement if the Renter does not transfer the records to the Village. Finally, upon completion of
the Agreement., the Renter shall transfer, at no cost to the Village, all public records in possession
of the Renter, or keep and maintain public records required by the Village. If the Renter transfers
all public records to the Village upon completion of the Agreement, the Renter shall destroy any
duplicate public records that are exempt or confidential and exempt from public records disclosure
requirements. If the Renter keeps and maintains public records upon completion of the Agreement,
the Renter shall meet all applicable requirements for retaining public records. Records that are

stored electronically must be provided to the Village, upon request from the village's custodian
of public records, in a format that is compatible with the Village's information technology systems.

12. HEADINGS: The headings contained in this Agreement are provided for convenience
only and shall not be considered in construing, interpreting or enforcing this Agreement.
13. SEVERABILITY: The invalidity or unenforceability of any provision of this
Agreement shall not affect the validity or enforceability or any other provision of this
Agreement and this Agreement shall be construed and enforced in all respects as i f' the invalid
or unenforceable provision is not contained herein.
14. WAIVER: No waiver by the village of any provision of this Agreement shall be
deemed to be a waiver of any other provisions hereof or of any subsequent breach by the Renter
of the same, or any other provision or the enforcement hereof. The village's consent to or
approval of any act requiring the Village's consent or approval of any act by the Renter shall
not be deemed to render unnecessary the obtaining of the Village's consent to or approval of
any subsequent consent or approval of, whether or not similar to the act so consented or
approved.

Playground Supervision -

to be maintained at all times with the individual coach's play group. All coaches need to maintain a head
count oftheir individual group. All bathroom breaks will bedone onthe buddy plan. 1ncase of

Interview Process
All coach candidates will fill out an application and be interviewed by administrative staff. An emphasis
will be made on experience, working with children, and love for children more than sports. AN applicants
will provide references. if hired, all coaches attend a pre -camp training session with our Program
Director who goes over the rules of the camp and responsibilities of our coaches. All coaches are
fingerprinted and background checked tomeet summer camp guidelines. All coaches are CPR and first
aid certified.

Introduction
Welcome to SportsTyme.
The material outlined in this handbook was the work of many great coaches who shaped SportsTyme into
the program it is today. SportsTyme has been operating for 19 years, and during that time, our coaches
have positively impacted the lives of thousands of young people. I should know. I was one of those young
people.
I attended SportsTyme back in 2003 as a shy kid filled with anxiety about school. For the next several
Summers, Coach Keith and Coach Dan taught me to laugh, shout, chant, and play. While I can't remember
the names of the friends I made attending SportsTyme, I do remember the coaches.
Kids rarely get to see adults have fun. Maybe that is because some adults have forgotten how. At
SportsTyme, things are different. SportsTyme is a place where the young and the young -at -heart come
together to have fun, No textbooks, No grades. No standardized tests. No strict curriculum or big
expectations.

How to read this handbook
As you read this handbook. you'll come across sections labeled Mandato1�/. Manclatories are very
important to the program because they help fulfill requirements set forM by the American Camp Association
Aside from Mandatories, you'll also find our Best Practices contained within. Best Practices are
suggestions rather than requirements. We collect and expand our best practices every year, based on coach
surveys and feedback.
Please set aside 15-20 minutes to read this entire handbook in one sitting. The end of this handbook
includes a detachable "cheat sheet" to help you retain and easily review what you have learned, but do not
only read that, Context is everything,

Campers can bring cellphones and other personal electronics to camp: however, they are only allo�-ved to be
used during unstructured parts of the day. \,%thich includes open gym, snack, and lunch breaks.
Campers who abuse this privilege by using their devices during structured activities, or using it for
inappropriate behavior. should have their privileges revoked,

CR. 2 Rules of Respect
Mandatory
-Do unto others as you would have them do unto you." At SportsTyme, the Golden Rule informs our Rules of
Respect. The Rules of Respect are as follows:

By reciting the Rules of Respect every day, we communicate our expectations for campers and reinforce
those expectations.

Discipline Procedure — "3 Strike Rule"
When a child breaks a Rule of Respect, we follow our discipline procedure to ensure that bad behavior is not
allowed to continue.
Every camper receives a wristband at the start of the day. which they are required to wear until they leave.
The wristbands keep parents informed by showing them at -a -glance how their child is behaving at camp.
The first time a child breaks a Rule of Respect,
they get an 'X' on their wristband.
2. The second time a child breaks a Rule of
Respect, they get their wristband taken away,

Respect, the coach fills out a Behavior Report
Form (see CR. 4) and gives it to the director.
Best Practices
After marking a wristband with an *X- or taking it
away from a camper. ask the group which Rule of
Respect was broken. By doing this. we achieve two
things:
We reinforce learning by having campers recite the rule.
We show the campers that breaking a Rule of Respect has real consequences.

Filling out Behavior Report Forms is never fun, but it is necessary. If you have a child in your group %,vho is
consistently misbehaving and the parents never find out about it. then you are at fault, not the child. If you fill
this form out, be sure to give it to your director as soon as possible. They will make sure it makes it home.

Code of Conduct (CC)
At SportsTyme. we teach our campers a philosophy of respect. but we can't champion that philosophy
unless we practice it ourselves. We must create a working environment where mutual respect can grow and
flourish. In this section, we will highlight what it means to be a responsible member of the team.

Work schedules are managed by the director using an online platform called 'When I Work.' It is vitality
important that you check camp dates on the SportsTyme website and submit for time -off you might need
before the season starts. Time -off requests submitted after the season starts are subject to director approval.

It is every coaches' responsibility to check When I Work and adhere to the schedule by arriving on -time for
their shift each day. Inform the director before leaving at the end of each shift if they are still on campus.

Every coach working a full shift (8.5 hours) is required to take a 30-minute break each day. This break is
unpaid, so you are welcome to come and go from the campus as you please. Ask your director when your

Because a coach who utilizes a whistle correctly never has to raise their voice.
For example, before starting your first activity on Monday, let your group know that whenever they hear the
whistle blown three times. everyone needs to freeze. Suddenly, getting quiet is a fun game. Practice this

If a parent needs to be contacted (emergency or not), please alert your director. Unless your director gives
you explicit instructions to the contrary, contacting a parent is their responsibility.

Coaches need to support fellow staff mer-ribers by sharing the workload, Coaches need to take turns sharing

If you find yourself melting into the background while other coaches take the lead, be more proactive by
offering help. Conversely, if you find yourself continually taking the lead, you should step back and encourage
your fellow coaches into more active roles.

CC. 9 Coach Participation
Mandatory
Coaches need to engage during structured and unstructured activities actively. Kids need guidance and
should not be left alone to figure things out on their own.
• Coaches should play alongside campers, not sit on the sidelines, and this includes both structured
and unstructured time. such as open gym.
• If a child is sitting out, go out of your way to make him or her feel welcome and included. Make
things fun for campers, which is particularly important during unstructured time (open gym).
Best Practices
Whilc, it is true that the director sets the activity
schedule, coaches have a lot of control over how
each activity is played. The best coaches can
sense when campers are not engaged, and they
use their creativity to put a spin on things. For
example, tell campers that the first person to hit
a bullseye in archery wins candy. Or put a spin
on a soccer game by pitting the boys against the
girls (with the coach playing on the weaker
team). The only limit to an activity is your
imagination!

Mandatory
It is each coaches' responsibility to ensure they are fulfilling the mandatories outlined in this handbook. Any

comes from a director after a verbal warning. A formal write-up may become grounds for dismissal, especially
if the pattern of misconduct continues.

Safety is our top priority.
SP.1 Headcounts
Mandatory
Once coaches are assigned a group. it is their responsibility to ensure that no child wanders off without.
supervision. All coaches must take a headcount to establish the number of kids in their group. and then
recount their kids before each activity,
If you perform a headcount and find you are missing a child, please stay with your group and contact your
director for assistance.

Keep your group hydrated. Coaches need to encourage campers to

SP. 3 Bathroom Procedure
Mandatory
When monitoring bathroom breaks, coaches must make sure that privacy is always maintained. If kids are
misbehaving in the bathroom, then call them outside and deal with it there. Never accompany a camper to
the bathroom alone (see SP. 4).
Best Practices
If you are leading a group of younger children (5-8) be sure to take regular bathroom breaks (preferably
between each activity). Younger children are less attuned to their bodies, but a child says they must go right
away, take their word for it. It is better not to risk an accident.
For older campers (9-13), you do riot need to take regular bathroom breaks. We have enough meal breaks
throughout the day that they typically do not need one. If an older camper needs to go immediately, you may
send them using the buddy system. Make sure campers are not gone too long. Kids like to cause trouble in
the bathrooms, where they know adults are not watching. Call your director if you need assistance.

SP. 4 One -on -One Policy
Mandatory
Coaches should never place themselves in a situation where they are one-on-one with a camper. If a coach

If you need to escort a child to the bathroom, or someplace other people won't be around, ask the child to
bring a friend or two with them. As always, call your director if you need assistance.

EM. I Intruder &Active Threats
Mandatory
If there is an adult on campus who is riot accompanied by a coach, and YOU do not recognize him or her as
a school administrator, approach immediately, or alert your director, It is everyone's responsibility to stay
vigilant for potential intruders and active threats.

suspicious activity occurring on or around campus.
EM. 2 Injuries/I Ilness
Mandatory
Coaches can and should treat campers for minor scratches, bumps. and bruises sustained during camp,
Coaches are encouraged to use their best judgment and training in healthcare matters, and alviays err on the
side of caution. Do not attempt anything outside our scope to handle. Ask the director where first -aid kits are
located and do not hesitate to ask for assistance.
SportsTyme does not retain an on -site nurse. In the event of a significant injury. coaches should do
everything in their power to aid and assist. Coaches should use their best judgment and contact emergency
services if they believe that time is of the essence. Coaches also need to contact the camp director as soon
as the situation allows. In the event of any injury or illness. coaches must complete an Accident -Injury Form
(see Ell. 3.).
