St. Jude's Church; Zoning Text Amendment;

As you know, in 1987 the Village deleted churches as a Special
Exception Usage within the C-2 zoning district. There were a
variety of reasons for doing this which we have previously
discussed. We were aware that this action made St. Jude's a non-
conforming use which could be a problem in the event of
structural damage to the building with a corresponding desire to
rebuild thereafter.
The Village Council has declared "zoning in progress" while
staff continues to work on an ordinance to implement the
provisions of the Master Plan. A church on the St. Jude's
property is provided for in the Master Plan. Therefore, once
the Master Plan is implemented, St. Jude's would no longer be a
non -conforming use.
Waiting for the adoption of an ordinance implementing the Master
Plan may be untimely for St. Jude's in that they have developed
elaborate designs for a new facility. A fund drive has already
commenced. For this and other reasons, St. Jude's wishes to
eliminate this non -conforming situation that their property is
currently faced with.
St. Jude's proposes to amend the Zoning Ordinance so that
churches and publicly owned and operated community buildings
become a Special Exception Use in the C-2 Community Commercial
District. In order to accommodate the Church, I recommend that
the zoning text amendment be given your approval with the
following conditions:
o Specific Special Exception
to churches so as to:
1) Specify a minimum lot size.
criteria be developed to apply
2) Require churches to be within a free-standing building.
3) Require a minimum square footage for the required free-
standing building.

These conditions, and any others that may be suggested by the
Village Attorney, would help to insure that future churches will
be of a nature similar to that of St. Jude's and/or that new
facility contemplated by St. Jude's. Should you accept these
recommendations, the changes would be included in the ordinance
amending the Zoning Code prior to the first advertisement for
the Public Hearing that is contemplated to be held on January
10, 1991.
