SUBJECT: Removal Of 60,00OGallon Elevated Tank
To follow up our conversation regarding this tank, I would like
to provide a historical overview leading up to today.
The elevated tank located at Old Wellfield No. 1 was part of
the water system started by the Jupiter Water Company in 1954 to
serve the Jupiter Inlet Colony. As the adjacent area began to
develop, the water system was extended to serve the Village of
Tequesta and the surrounding areas. In 1967 the Village purchased
this water system and beginning in early 1975 the Village hired Gee
& Jenson to develop a masterplan for the water distribution system.
In their May, 1975, report it was pointed out that the 60,000 gallon
storage tank at that time would provide less than 30 minutes of
water supply and this tank was of little value to the system.
By 1983 the tank had deteriorated to such a level that repairs
were needed immediately. The Village made repairs and painted this
structure in 1984 at a cost of $59,550. This included the
installation of a cathodic protection system.
In April of this year we conducted an appraisal of this tank
relative to its condition and value to the water system today. Our
conclusions were:
o Because the water system has outgrown the capacity of this tank,
its functional purpose is insignificant relative to flows and
pressures.
o The exterior polyurethane coating has faded and is chalking ex-
tensively, far short of its life expectancy and new painting is
required.

o Turnbuckles under the main bowl have extensive rust and deterior-
ation which may need sandblasting and/or replacement.
We contacted three companies who provide the type of services
we possibly would need for structures of this size. We looked at
painting with minor repairs, dismantling and selling the tank. What
I found was quite surprising. Due to EPA requirements and the
proximity of building and automobiles, painting this dinosaur with
proper containment would cost anywhere from $15,000 to $35,000.
Dismantling costs range from $15,000 to $20,000. Of the companies
contacted, Utility Service of Perry, GA, also expressed an interest
in purchasing this tank from us. Which brings us to date.
I have recently asked RMA Engineers to review the technical
functions of this tank and their analysis concurs with our
findings. I feel in the best interest of the Village we should
remove and sell this tank to Utility Service of Perry, GA. Skip
Randolph has prepared a Bill of Sale which has been reviewed and
accepted by Mr. Frank Shelton of Utility Service. Mr. Shelton would
pay the Village $2,500, dismantle the tank and remove it from the
Village (a copy of this Bill of Sale is attached). We would,
however, extend the time of performance to six months from date of
execution of the Bill of Sale.
I would appreciate it if you would place this on the Council
Agenda of November 8, 1990, for their authorization to execute.
I strongly feel opportunity is knocking on our door and we
should immediately take full advantage to save a significant sum of
money.

BILL OF SALE
KNOW ALL ME BY THESE PRESENTS, that the Village of Tequesta,
a municipal corporation in the County of Palm Beach and State of
Florida, party of the first part, for and in consideration of the
sum of TWO THOUSAND FIVE HUNDRED AND N0/100 DOLLARS ($2,500.00),
lawful money of the United States, to it paid by FRANK SHELTON,
INC. T/A UTILITY SERVICE, party of the second part, the receipt
whereof is hereby acknowledged, has granted, bargained, sold,
transferred and delivered, and by these presents does grant,
bargain, sell, transfer and deliver unto the said party of the
second part, its executors, administrators and assigns, the
following goods and chattels:
One (1) 60,000 gallon elevated tank
Party of the second part hereby agrees that said tank shall be
disassembled and removed from its location within the Village of
Tequesta no later than January 20, 1991. In the event the tank is
not removed by that date, the $2,500.00 herein paid to the Village
of Tequesta shall be forfeited to the Village by the party of the
second part as liquidated damages to the Village for failure to
remove the tank. Thereafter, party of the second part shall have
no further claim to said tank and the tank will remain the property
of the Village of Tequesta for it to use or dispose of as it sees
fit.
Party of the second part shall save and hold harmless the
Village of Tequesta for any claims for personal or property damage
resulting from the negligence of the party of the second part in
the dismantling and removal of the tank. Party of the second part
shall have in place at the time of dismantling and removal a policy
of insurance satisfactory to the Village which would cover any
claims made for personal and/or property damage resulting from
removal of the tank.
To have and to hold the same unto the said party of the second
part, its executors, administrators and assigns forever.
And the party of the first part does for it and its heirs,
executors and administrators, covenant to and with the said party
of the second part, its executors, administrators and assigns, that
it is the lawful owner of the said goods and chattels; that they
are free from all encumbrances; that it has good right to sell the
same aforesaid, and that it will warrant and defend the sale of the
said property, goods and chattels hereby made, unto the said party

of the second part, its executors, administrators and assigns,
against the lawful claims and demands of all persons whomsoever.
IN WITNESS WHEREOF, the parties have caused this instrument to
be executed this day of October, 1990.
