SUBJECT: Preliminary and Final Re -Plat Review
Lots SA & 8B, Block 2, Country Club Point
JARA, Inc., Joseph M. Arbree, Applicant.
Tom, attached are nine (9) sets of review packets and
nine (9) sets of the re -plat -f the above referenced project. A
complete review of the proposed project has been performed by the
building department in conjunction with the Village's consulting
engineers, Gee & Jenson. The issue regarding the differences in
the legal description versus the total land area as indicated on
the re -plat has been addressed by the Village Attorney in
conjunction with the applica-A's attorney, surveyor and title
company.
Please place this item on the agenda of the October 11,
1990 Council meeting for review and consideration under
Development Matters. Thank you.

Dear Sir;
With regards to the certification of the above named replat, as of
September 13, 1990, at 8:00 A.M., I further certify to the following:
A. The parties executing the Plat are in fact the owners of the
lands described in the Plat.
B. The are no open mortgages, encunberances, or liens against the
property as described in the Plat.
C. All county taxes on the property as described in the Plat are
paid to Decw ber 31, 1989. The tax bills for 1990 have not yet
been issued by Palm Beach County.
D. The description of the property as shown on the Plat is
correct.

In response to the August 29, 1990 letter by Polestar Surveying
and Mapping concerning the easterly boundary line of Lot #8, we do
not concur with their response.
Plus or minus shore lines are appropriate when there is a variable
shore line and when accretion of additional land is probable.
However, any accretion has to be gradual and by natural causes and
a bulkhead is not considered a natural cause. In addition, the
new dimension is approximately 18, longer than the platted
dimension of 145+. For these reasons we consider this to be a
signficant addition of property, the ownership of which is unknown
at this time. We believe that the bulkhead details, which were
permitted through the Village of Tequesta, should be reviewed to
determine if they would shed light on the method that the property
was accumulated; i.e., natural causes or by backfill behind a
bulkhead.
We do not have an argument with the surveyor over whether the
bulkhead was properly permitted or whether the property is above
the mean high water line. Our concern is to the establishment of
the ownership of the property on the eastern portion of proposed Lot
8B.

Dear Sir;
With regards to the proposed replat of Lot 8, Block 2, COUNTRY CLUB
POINT, we have made an examination of the title to the property.
Through the examination we found the legal description as shown on the
said proposed plat does correctly describe the property.
The only restrictive covenant that affects the said proposed plat, is an
"ANCHOR FASRMIM" that is shown on the original Plat of COUNTRY CLUB
POINT as recorded in Plat Book 12, page 112, Public Records of Palm
Beach County, Florida. However this same easement has been shown on the
said proposed Plat.
We have also found that as of August 21, 1990, at 8:00 A.M., there have
been no recorded Mortgages, or Mortgage holders that affect or encumber
the property as described on the said proposed Plat.

IN RESPONSE TO THE ENGINEERING CONSULTANT'S COMMENT NUMBER ONE,
OF LETTER DATED AUGUST 22, 1990, I FEEL THAT THE PLAT, AS
SUBMITTED, PROPERLY DEFINES THE SIZE AND SHAPE OF SAID LOT 8. THE
PLUS OR MINUS DIMENSIONS ON THE ORIGINAL PLAT ARE COMMONLY USED
ON PLATS TO DEFINE BOUNDARY LINES THAT ARE IN CONSTANT MOTION.
THE SEAWALL WHICH NOW DEFINES THE EASTERLY BOUNDARY OF SAID LOT
8, WAS PROPERLY PERMITTED THROUGH THE VILLAGE OF TEQUESTA. THE
SURVEY CONTAINED IN SAID PERMIT ALSO SHOWS THE SHORELINE OF LOT 8
TO BE APPROXIMATELY 8 FEET EAST OF THE PLUS OR MINUS PLATTED
SHORELINE. IT IS NOT AT ALL UNUSUAL TO FIND DIMENSIONAL
DIFFERENCES WHEN PLUS OR MINUS DIMENSIONS ARE USED ON PLATS.

Dear Steve:
Our review of the above referenced plat has resulted in the
following comments:
1. The submittal plat contains a different dimension (163.73
ft.) for the North Line of Lots 8A and 8B while the
original plat of County Club Point shows a dimension of
145 +. Enclosed is a copy of the original plat.
2. Application should supply exact average or area in square
feet of the two lots. We are unable to verify the lot
requirements for lot width because of Comment No. 1.
The applicant should address the above comments and re -submit the
referenced plat for approval. Please call should you have
questions on this matter.

stated that the applicant will abide by the provisions that were
applicable at the time the applicant first came before the Village
Council, April 26, 1990 (approved under and subject to the
requirements of Ord. 398).
