SUBJECT: Proposed Ordinance Creating Regulations Governing the
Handling and Disposal of Land Clearing and Construction
Debris; Agenda Item
Attached, please find correspondence received from the Solid
Waste Authority expressing concerns relative to a decline in the
waste stream in Palm Beach County. In an attempt to be
cooperative, we reviewed the suggestions of the SWA and found that
the Village currently does not require contractors to utilize
construction debris containers at a job site. Requiring this
through the proposed Ordinance will further limit the probability
of illegal dumping. It is recommended that the Village Council
approve this Ordinance on first reading.

SUBJECT: Disposal of Solid Waste
Attached hereto, please find a Memorandum received from Tim
Hunt, Executive Director of the Solid Waste Authority expressing
concern relative to radical reductions in the waste stream in Palm
Beach County within the last few months. In response to this
matter, Mr. Preston i;: requested to contact Nichols Sanitation and
request that he be furnished with copies of all weight tickets
received by Nichols Sanitation relative to Village of Tequesta
collections. Additionally, Mr. Ladd is requested to look into the
feasibility of requiring a copy of the disposal bill from
contractors for construction debris prior to issuing a final CO.
If feasible, please implement.

request, please contact me.

SUBJECT: Disposal of Solid Waste
A
Recent solid waste disposal audits indicate that the waste stream in Palm Beach
County has declined dramatically in recent months. Recycling activities have contributed
to this decline but not to the extent that has been experienced.
The Solid Waste Authority is requesting that all municipalities, if they are not
already, begin verifying that their haulers are in fact delivering all waste collected to a Solid
Waste Authority designated facility as required by Chapter 75-473, as amended.
It is absolutely necessary to the solid waste system that all waste be brought to the
Authority's facilities and not delivered to an adjoining county or undesignated facility.
Verification of proper disposal can be made by requiring copies of all weight tickets
received by the hauler be furnished to the municipality. Building or Code Enforcement
Sections can verify that construction debris has been delivered to an Authority designated
facility by requiring a copy of the disposal bill from the contractors prior to issuing a final
CO.

TITLE AND PURPOSE; PROVIDING REQUIREMENTS FOR
APPROVED ON -SITE REFUSE CONTAINER, MAINTENANCE DURING
CLEARING AND CONSTRUCTION, REMOVAL OF CONTAINER AND
VERIFICATION OF PROPER DISPOSAL OF LAND CLEARING AND

BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1._ Title. This Ordinance shall be known
as, and may be cited as the "Land Clearing and Construction
Debris Handling and Disposal" Ordinance of the Village of
Tequesta, Florida.

Section_3. Requirements. All land clearing, new
construction, additions, alterations, remodeling and
demolition of existing buildings, structures and/or
facilities shall comply with the requirements set forth in
this Ordinance as follows:
a. An approved dumpster/container shall be required
to be located at a lot or parcel subsequent to a
land clearing or building permit being issued.
b. The required dumpster/container shall be
delivered, maintained and removed by a licensed
solid waste hauler.
C. The contractor or an owner/builder shall obtain
from the licensed hauler or solid waste authority
designated facility a copy of the disposal bill
or other appropriate form upon completion of the
job and removal of the dumpster/container and
present this document to the building department
prior to the issuance of a certificate of

Section 4. Administrative fines. Consistent with
law and this Ordinance, the Village of Tequesta Code
Enforcement Board shall have jurisdiction to enforce the
provisions of this Ordinance within the Village of Tequesta
corporate limits. The Code Enforcement Board, upon
notification by the Code Enforcement Officer that an order of
the Code Enforcement Board has not been complied with by the
set time or, upon finding that the same violation has been
repeated by the same violator, may order the violator to pay
a fine not to exceed two -hundred and fifty dollars ($250. 00)
for each day the violation continues past the date set for i
compliance or for each time the violation has been repeated,
and a hearing shall not be necessary for issuance of the
order.

Section 5.-
Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or
applications of this Ordinance which can be given effect
without the invalid provisions or applications, and to this
end, the provisions of this Ordinance are hereby declared
severable.
Section 6.. Codification. This Ordinance shall be
codified and made a part of the official Code of Ordinances
of the Village of Tequesta.
Section 7. Effective Date. This Ordinance shall
take effect immediately upon its passage and approval, as
provided by law.
