RE: Findings of Interjurisdictional
Incompatibilities
Dear Mr. Annunziato:
This letter and attachments shall serve as the response of the
Village of Tequesta tL) the Findings of Interjurisdictional
TnCoinpatibilities transmitted to the Village by the beach
Countywide Planning Council un July 23, 199o. Attached are
completed Mapped Potential Interjurisdictional Incompatibility
Resolution Tables related to iizterjuriydictional incompatibilities
associated with land use classifications as designated by the
Village of Tequesta atld adjacent local governments. As to the
obligation to respond to the numerous Policy Potential
Interjurisdictional Incompatibility Findings, at this time the
Village of Tequesta declines to commit the time and public tunas to
address the same.
The Village of Tequesta has expended substantiul resources to date
pursuant to its obligations under Fla. Stat. ch. 163. The
Comprehensive Plan of the Villdge of Tequesta was initially found
not in compliance pursuant to Chapter 163 by the State of Florida
Department of Community Affairs. The Village is currently
proposing amendments to its cumprenensive plan pursuant to a
Stipulated Settlement Agreement to resolve disputed issues of tact
and law between the Village and the Department of Community
Affairs. Accordinyly, it is the position of the Village that until

such time as its plan is found in complidnce by the Uapart,aent of
Community Affairs, responding to the alleged Policy Potential
Interjurisdictional Incompatibility Findings is premature.
Further, the Village questions the underlying authority of the palm
Beach Countywide Planning Council to ?_ndapendently c le its 0Y0!j
list of policy statements and require a local government to commit
extensive time and financial resources to respond to the same. The
charter provision authorizing the formation of the Palm Beach
Countywide Planning Council mandates a compilation of land tise
elsmentn as promulgated by each local government within Palm Beach
County. It is respectfully suggested that the policy statements of
the Planning Council exceed the mission assigned to the Planning
Council as well as the underlying authority provided the Planning
Council by voter referendum.
Please advise if additional information is necessary regarding the
above.

Article VII of the Palm Beach County Code requires that the Palm Beach Countywide Planning Council develop a Countywide Future
Land Use Element that coordinates the planning processes of all govemments within the County and resolves and prevents
incompatibilities and conflicts among local govemments' Land use planning efforts. The Planning Council has adopted policies in
various topic areas b identify, prevent and resolve incompatibilities as defined in Article VII. An inconsistency between a local plan
policy and a requirement of a Council policy, or lack of an equivalent local government policy, constitutes an interjurisdctional
incompatibility.
Article VII of the Charter also requires that the Countywide Future Land Use Element be developed pursuant to Chapter 163, F.S.,
and Chapter 9J-5, F.A.C. Since the Countywide Future Land Use Element is required to be created from a composite of local
ccmprehensive plans, a number of the Chapter 9J-5 future lard use element requirements will be inet by c.-eati.+g a composite of, or
referencing where appropriate, the policy or objectives used to meet those requirements in the local plans.
The Policy Potential Interjudsdictional Incompatibility Report Form lists instances where a local comprehensive plan is inconsistent
with any of the Councirs 'ensure' statements from the Council's adopted polices and with the policies necessary to meet Chapter
9.1-5 future land use element requirements. On the Report Form is listed each Council or Chapter 9,;-5 the element.
