SUBJECT: DCA vs. Village of Tequesta;
Stipulated Settlement Agreement
Attached hereto, please find documentation relative to the
above referenced which includes a copy of the Notice of Change of
Land Use advising of a public hearing to consider the resolution
approving the Settlement Agreement, the Stipulated Settlement
Agreement and exhibit A and B thereto. Please sufficiently
familiarize yourself with this information so that you and/or Jack
Horniman and/or Jay Jurgens, Esq. can sufficiently explain this
process to the Village Council on August 9th. Tom Hall, Water
System Manager, should be able to speak to the impacts of this
Agreement to his Department and his ability to meet the applicable
policies and objectives.

NOTICE OF CHANGE OF LAND USE
TO THE CITIZENS OF THE VILLAGE OF TEQUESTA,
TO ALL PARTIES IN INTEREST AND TO ALL WHOM IT MAY CONCERN:
The Village of Tequesta proposes to approve a Resolution regarding the Comprehensive Plan for the area shown in the map in tf'tif<
advertisement.
A Public Hearing on the Resolution will be before the Village of Tequesta Village Council on Thursday, August 9, 1990 at 357 Tequesta
Drive, Tequesta, Florida 33469 commencing at 7:00 P.M. The Council shall consider a Resolution approving a Settlement Agreement
between the Village of Tequesta and the State of Florida Department of Community Affairs. The Settlement Agreement resolves the
factual and legal dispute between the Village of Tequesta and the Department of Community Affairs regarding the determination by the
Department that the Comprehensive Plan adopted by the Village of Tequesta on October 12,1989 was not in compliance with Fla. Stat.
ch. 163.
RESOLUTION NO. 12-89/90
Resolution of the Village of Tequesta, Florida, pursuant to Chapter 163.3161, et seq., Florida Statutes, approving a
Settlement Agreement between the Village of Tequesta and the State of Florida Department of Community Affairs-,
directing the Town Manager to undertake the requisite measures to effectuate the terms of the Settlement Agreement.
PLEASE TAKE NOTICE AND BE ADVISED, that if any interested person desires to appeal any decisions made by the Village Council
with respect to any matter considered at this hearing, such interested persons will need a record of the proceedings, and for such
purpose will need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon
which the appeal is to be based.
