Harrison, Ass stant to the Village Manager DATE: June 22, 1990 SUBJECT: Application for Waiver to Landscape Ordinance No. 377 Step Saver Please find attached an application for Waiver to Landscape Ordinance 377 from the representative of the owners of Step Saver. This application concerns the Step Saver property located at the northwest corner of Tequesta Drive and U.S. Highway One, and is brought before you as part of the continuing right-of-way condemnation proceedings for the Tequesta Drive project. The attached application is very specific and is only intended to give credit to the property owner for those landscaped areas condemned by the Village. If granted, this waiver will not completely release Step Saver from any other provisions, including the amortization requirement, of Ordinance No. 377. 1 7 See v19pI KAt, h As you will note, the waiver is requested for two feet of "landscaping credit" along the southern property line of the parcel and for three feet along the southeast property line. If this waiver request is granted, under the current ordinance which requires a ten - foot landscape buffer along public road rights -of -way, Step Saver would be permitted to supply an eight -foot buffer along Tequesta Drive and a seven -foot buffer along the southeast corner. All other landscaping requirements would remain unchanged. Village staff recommends that Village Council approve this request due to the following: 1. The Vilage Attorney recommends that this waiver be granted as the property owner has indicated he would settle the condemnation suit upon receiving this waiver. It would be potentially very costly not to settle now and gas stations are particularly difficult in condemnation suits. The landscaped areas taken from this parcel have been replaced by Village -owned and improved landscaped areas, so there is no visible net loss in landscaping at the site.
