SUBJECT: Ordinance No. 405, 406, 407 & 408;

Ordinance 405 through 408 are the continuation of the next
phase of the creation of the Village of Tequesta Land
Development Regulations (LDR). The Village is required to
prepare LDRs as an implementation vehicle of the Comprehensive
Development Plan adopted by the Village Council for the
Village. These ordinances accomplish those purposes.
I have asked Jack Horniman to be at this Council Meeting to
review the highlights of each ordinance and its relationship to
the Comprehensive Development Plan for your benefit.

ORDINANCE
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA. AMENDING THE
CODE OF ORDINANCES OF THE VILLAGE OF TEQUESTA BY
AMENDING CHAPTER 61 BUILDINGS AND BUILDING
REGULATIONS, ARTICLE V, HOUSING, BY AMENDING THE
STANDARD HOUSING CODE AT SECTION 202, DEFINITIONS;
AND BY AMENDING SECTION 309.1, DANGEROUS STRUCTURES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATES.
BE IT ORDAINED BY THE Village Council of the Village
of Tequesta, Palm Beach County, Florida, as follows:
Sect ion 1. Chapter 6, Article V, of the Code of
Ordinances of the Village of Tequesta is hereby amended by
amending the Standard Housing Code, 1988 Edition, and
subsequent editions, at Section 202, Definitions, by adding
new definitions as follows:
Housing Conditions. Include conditions as follows:
a. Residential Struc_tu_re. A structure, or portion
thereof, used as a dwelling place for one or more
families or households; but not including
occupancy of a transient nature such as in
hotels, motels or time—sharing uses.
b. Standard Condition. A residential structure
meeting all minimum standards for basic equipment
and facilities as set forth in the Standard
Housing Code, latest adopted edition.
C. Substandard_ Condition. A residential structure
which does "not" most all minimum standards for
basic equipment and facilities as set forth in
the Standard Housing Code, latest adopted
edition, and where the costs of rehabilitation,
renovation or code compliance are valued at less
than fifty percent, (50%), of the assessed value
of the structure.
d. In Need of Replacement. A residential structure
which does "not" most all minimum standards for
basic equipment and facilities as set forth in
the Standard Housing Code, latest adopted
edition, and where the costs of rehabilitation,
renovation or code compliance are valued at
greater than fifty percent, (50%), of the
assessed value of the structure.
Section 2• Chapter 6, Article V, of the Code of
Ordinances of the Village of Tequesta is hereby amended, by
amending the Standard Housing Code, 1988 Edition, and
subsequent editions, at Section 309.1 by adding a new sub—
paragraph 3. as follows:
3. One which meets the definition of "in need of
replacement" as set forth in this Code at Section
202, Definitions.
Section 3. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or
applications of this Ordinance which can be given effect
without the invalid provisions or applications, and to this
end, the provisions of this Ordinance are hereby declared
severable.
Section 4. Codification. This Ordinance shall be
codified and made a part of the official Code of Ordinances
of the Village of Tequesta.
Section_5. Effective Date. This Ordinance shall
take effect immediately upon its passage and approval, as
provided by law.
THE FOREGOING ORDINANCE was offered by

adoption. The Ordinance was seconded by
Councilmember _ and upon being
put to a vote, the vote was as follows:
