SUBJECT: Resolution No. 5-89/90; Opposing the Abolition
and Restructuring of the Palm Beach County
Solid Waste Authority; Agenda Item IX, B
Solid waste collection and disposal continues to be one of the
primary functions of the Village of Tequesta which we may often lose
sight of by virtue of contracting the collection services to Nichols
Sanitation and the operation of appropriate landfills by the Solid
Waste Authority. The Solid Waste Authority of Palm Beach County is
an independent special district within Palm Beach County and the
municipalities currently enjoy representation on its Governing
Board. The Board of County Commissioners of Palm Beach County is
seeking to have the State Legislature abolish the Solid Waste
Authority by dissolving the same and transferring all of the Solid:
Waste Authority' s assets to Palm Beach County.
By means of the recent referendum, the Palm Beach County Board
of County Commissioners are soon to be allocated into single member
districts _whereby each member will be elected from the district in
which he or she resides. Difficult decisions regarding siting of
Solid Waste Management facilities will become even more political if
the Solid Waste Authority is abolished and those functions turned
over to Palm Beach County. It is imperative that the Solid Waste
Authority retain its autonomy as an independent special district due
to the extremely difficult task of siting landfills, resource
recovering plants, transfer stations and other waste management
facilities. The need for the Governing Board of the Solid Waste
Authority to be independent and non-partisan will be even more
critical as land space grows scarce.
It is recommended that the Village Council adopt Resolution No.
5-89/90 which urges the Board of County Commissioners and the
Legislative Delegation of Palm Beach County to continue the Solid
Waste Authority as it exists and not to tamper with it for special
interest political purposes.

A RESOLUTION OF THE VILLAGE OF TEQUESTA; PALM BEACH
COUNTY, FLORIDA, URGING THE BOARD OF COUNTY
COMMISSIONERS OF PALM BEACH COUNTY AND THE PALM BEACH
COUNTY LEGISLATIVE DELEGATION NOT TO SUPPORT THE
TRANSFER OF ALL ASSETS AND LIABILITIES FROM THE SOLID
WASTE AUTHORITY OF PALM BEACH COUNTY TO THE BOARD OF
COUNTY COMMISSIONERS, AND NOT TO SUPPORT A
RESTRUCTURING OF THE SOLID WASTE AUTHORITY BOARD.
WHEREAS, it has come to the attention of the Village
Council of the Village of Tequesta that the selection and
purchase of land in the unincorporated area of Palm Beach
County, West of Boca Raton (Site 1) for the siting of a landfill
and possible resource recovery plant continues to be opposed by
certain residents and landowners in the affected area; and
WHEREAS, as a result thereof, one County Commissioner has
caused the preparation of a draft bill which would repeal
chapter 75-473, Laws of Florida, as amended, which established
the Solid Waste Authority of Palm Beach County. A copy of the
draft bill is attached hereto as Exhibit "A" . .
WHEREAS, said draft bill would transfer assets and
liabilities of the Solid Waste Authority to the Board of County
Commissioners, ostensibly for the purpose of negating the
selection of Site 1 as the future location of the South County's
landfill and resource recovery plant; and
WHEREAS, the abolition or restructuring of the Solid Waste
Authority is clearly not in the best interest of a majority of
the people in Palm Beach County because it would not adequately
provide for municipal representation; and
WHEREAS, the municipalities of the County continue to have
a strong governmental interest in the collection and disposal of
solid waste.
NOW, THEREFORE, BE IT RESOLVED BY the Village Council of
the Village of Tequesta, Florida:
Section 1. The Board of County Commissioners is strongly
urged not to recommend any bill which repeals Chapter 75-463,
Laws of Florida, or attempts to restructure the membership
balance of. the Solid Waste Authority Board.
Section 2. The Legislative Delegation of Palm Beach County
is likewise strongly urged to reject removal of governing
authority for solid waste disposal from the Solid Waste
Authority of Palm Beach County, or to permit the restructuring
of the membership to shift the membership balance of the Solid
Waste Authority Board.
Section 3. This Resolution shall take effect immediately
upon its adoption.
Section 4. Copies of this Resolution shall be forwarded by
the Village Clerk to members of the Board of County
Commissioners and the Legislative Delegation.

15 is the intent .of the Legislature that the Palm Beach
16 County Solid Waste Authority be hereby dissolved and that
17 all of ' said agency's assets, liabilities and operational
18 responsibilities do hereby revert to the Palm Beach
19 County Board of Commissioners. Such Assets shall include
20 but not be limited to all land holdings, all structures,
21 all equipment and all plant operations. Such liabilities
22 shall include but not be limited to any and all
23 outstanding indebtedness of any kind and amount.

On January 23rd the County Commission. decided to ask our
legislative delegation to 'change the make up .of the members on
the Solid Waste . Authority, The Authority was • .created by the
State Legislature in 1975 (Chapter ---7-5= -73, Special Acts of
Florida) . The "Act" set up a seven member governing .board to set
policy, (four members from the Municipal League and three from
the County Commission) . The-

The Municipal League has taken a strong position against any
changes in the Solid Waste Authority, including the make up of
its governing board. I am enclosing a copy of a draft resolution
for your municipality and a form letter for each of your elected
officials should they want to contact our legislative delegation.
