MEMORANDUM TO: Village Council FROM: Thomas G. Bradford, Village Manager ,-7-1*7)7 DATE: November 3, 1989 SUBJECT: Cypress Drive Drainage Project This is to present to the Village Council the current situation regarding the Cypress Drive Drainage project, currently configured as a joint project between the Village, Palm Beach County and the Town of Jupiter. In July of 1987, the Village entered into an Interlocal Agreement with the County and Jupiter to fund the design and permitting portion of the project, the purpose of which was to address the drainage problems existing along and around Cypress Drive. The Agreement distributed the costs as follows: 40% Village, 40% Jupiter and 20% County. The County is now proposing an Interlocal Agreement (attached) to fund preliminary land acquisition activities (total cost estimated to be $9,000+10%), which has been approved by Jupiter. The problems we have with this agreement, and with the project are as follows: o Based on updated drainage basin calculations, the Village's portion has been increased to 55%, with Jupiter and the County reduced to 35% and 10%, respectively. The Village's share amounts to over 50% because the basin includes areas extending north to the current north end of Cypress Drive, east to U.S. Highway One and west beyond Saturn Ave. Many of the developed properties in this area provide no on-site retention of stormwater. Gee & Jenson engineers have reviewed Jupiter's calculations and have found that the Village's share would reasonably be somewhere between 52% and 54%. o We have currently budgeted $25,000 in FY90 and $141, 100 in FY91 for this project. The $166, 100 total figure is based on Tequesta's share of the project at 40% and on the utilization of Special Assessments to area property owners expected to contribute 75% of Tequesta costs. To our knowledge, Jupiter has not committed to using the Special Assessment mechanism. Our review indicates that Tequesta has never used this technique, although that does not preclude its use in the future. Because economic benefits of drainage projects can be A i") MEMORANDUM: Cypress Drive Drainage Project November 3, 1989 Page 2 - tied to specific properties, these public projects are particularly suited to Special Assessment. However, it is critical that the Village Council revisit the issue of Special Assessment at this time in order for staff to continue to plan financially for this project. o The total project costs are currently estimated to be from $1,460,000 to $1, 550,000. However, final cost for property acquisition could change this figure significantly, as approximately 87,000 square feet of right-of-way are required. Palm Beach County is the agency negotiating for the property, while Jupiter's engineers designed the system. So, the Village has minimal control but could end up paying most of the costs. o Tequesta is being perceived as delaying the project as staff have been reluctant to recommend the attached agreement, especially as it would affect future agreements. Options at this stage include: 1. Approve the second agreement as proposed. Work with the County and Jupiter to reduce the Village's percentage in any forthcoming agreements. 2. Discontinue participation in the Cypress Drive project and investigate local alternatives to alleviate the drainage situation. 3. Work to acquire more control in the Cypress Drive project to better control costs and progress. I am herein requesting Council discussion and direction. It is our recommendation that you discuss the proposed Interlocal Agreement to provide direction to staff. We further recommend that staff continue to look into ways of addressing the drainage in an acceptable manner that would be lower in cost than the Cypress Drive project. Additionally, it is critical that the Council indicate the acceptability or unacceptability of the Special Assessment financing mechanism to staff at this time. TGB/WKH/mk d, i INTER-LOCAL AGREEMENT FOR THE CYPRESS DRIVE DRAINAGE BASIN SURVEY THIS INTER-LOCAL AGREEMENT, made and entered into as of the date of signing by the last executing party, by and between the TOWN OF JUPITER, a municipal corporation, THE VILLAGE OF TEQUESTA, a municipal corporation, and PALM BEACH COUNTY, a political subdivision of the State of Florida, hereinafter referred to as JUPITER, TEQUESTA and COUNTY, respectively: WHEREAS, the parties mutually desire to undertake the acquisition of the drainage areas of the Cypress Drive Drainage Basin area on an agreed cost sharing basis, in order to provide the necessary drainage retention and easements for the storm drainage project. NOW THEREFORE the parties agree as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The drainage area under consideration is known as the Cypress Drive Drainage Basin and is legally described or otherwise identified by the engineering sketch and/or description attached hereto, marked Exhibit "A" and made a part hereof. 3. Palm Beach County is hereby authorized to undertake the surveying for the future property acquisition of the aforesaid drainage area, consisting of abstracting , field surveying , development of survey sketches with legal descriptions and acquisition maps and development of warranty deeds. 4. The total cost for all labor, materials, services, reports and supervision for the Cypress Drive Drainage Basin survey is estimated to be the sum of $9,000.00 plus or minus ten percent (10%). After completion of the surveying, the County will present Jupiter and Tequesta with copies of the areas of acquisition and a statement of surveying charges. „ 5. JUPITER and TEQUESTA agree to reimburse COUNTY according to the following ratio for jointly sharing the total actual cost of the survey work between the parties: TOWN OF JUPITER 35% VILLAGE OF TEQUESTA 55% PALM BEACH COUNTY 10% 6. JUPITER and TEQUESTA agree •to make their respective reimbursement payment to COUNTY on or before thirty (30) days after receipt of a statement of surveying costs from the County. 7. The parties, through their various departments, employees and staff members, agree to give and extend prompt and reasonable cooperation to the County and each other, to carry out the purposes and intent of this inter-local agreement. IN WITNESS WHEREOF, the parties hereto have caused this inter-local agreement to be executed by their duly authorized officials on the dates indicated for each.
