SUBJECT: Ordinance Prohibiting Scavenging of Recyclable
Materials
Attached is an Ordinance for your consideration relative to
prohibiting scavengers from taking the recyclable materials
placed at curbside by Tequesta residents. This may seem
trivial, but we have received reports of this occurring and, if
left unchecked, this has the potential of financially effecting
the Recycling Program by reducing revenues received from
redemption of recyclable materials. Additionally, upon proper
enforcement of the Ordinance, it will reduce the flow of persons
traversing throughout the Village to scavenge for recyclable
materials.
It is recommended that the Village Council adopt this
Ordinance for the reasons stated herein.

ORDINANCE NO. 393
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING CHAPTER 10, "HEALTH AND
SANITATION" BY ENACTING A NEW ARTICLE V,
"RECYCLING BINS AND CONTAINERS", TO PROVIDE
THAT IT SHALL BE UNLAWFUL FOR ANY UNAUTHORIZED
PERSON OR AGENT TO REMOVE ARTICLES OR
OTHERWISE DISTURB MATERIALS IN THE VILLAGE' S
RECYCLING BINS, OR TO REMOVE, DAMAGE, OR
DESTROY SAID RECYCLING BINS, OR TO REMOVE
ARTICLES OR OTHERWISE DISTURB MATERIALS IN
CURBSIDE RECYCLING CONTAINERS, OR TO REMOVE,
DAMAGE OR DESTROY CURB RECYCLING CONTAINERS;
PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Chapter 10, "Health and Sanitation, of the Code of
Ordinances of the Village of Tequesta, be and the same is
hereby amended by enacting a new Article V, Recycling Bins and
Containers, to read as follows:
"ARTICLE V. RECYCLING BINS AND CONTAINERS
It shall be unlawful for any unauthorized
person or agent to remove articles or to otherwise
disturb materials in the Village' s recycling bins
or to remove, damage or destroy said recycling
bins. It shall be unlawful for any unauthorized
person or agent to remove articles or otherwise
disturb materials in curbside recycling containers,
or to remove, damage or destroy curbside recycling
containers. "
Section 2. All ordinances or parts of ordinances which are in
conflict herewith are hereby repealed.
Section 3. Should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity or the remainder
hereof as a whole or part thereof other than the part declared
to invalid.
Section 4. This Ordinance shall be codified and made a part of
the Official Code of Ordinances of the Village of Tequesta.
Section 5. This ordinance shall take effect immediately upon
its approval and passage as provided by law.
THE FOREGOING ORDINANCE WAS OFFERED BY Councilmember
who moved its adoption. The Ordinance
was seconded by Councilmember , and
upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed and
adopted this day of , 1989.
