Bradford, Village Manager .-----f7 DATE: September 21, 1989 SUBJECT: Occupational License Delinquency Fees The Occupational License Administrator has requested consideration of granting an additional thirty (30) days prior to the implementation of delinquency fees for Occupational Licenses. The reasoning behind this request is due to the fact that the Village in most instances must have proof of a County Occupational License prior to issuance of a Village Occupational License. Palm Beach County in most instances does not issue County Occupational Licenses until October 1 of each year. This causes many people to pay a delinquency fee due to no fault of their own. By extending the implementation of delinquency fees until November 1 of each year, the Village extends a reasonable period of time (30 days) to all applicants to receive their County license and apply for a Village license without payment of a delinquency fee. It is requested that your consideration be given to adoption of an Ordinance which would amend the current Village Ordinances to implement this change. TGB/mk ORDINANCE NO. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES: "LICENSES" ARTICLE 2 AT SECTION 11-25 RELATING TO OCCUPATIONAL LICENSE DELINQUENCY FEES, SO AS TO GRANT ADDITIONAL TIME FOR OCCUPATIONAL LICENSE RENEWAL PRIOR TO IMPLEMENTATION OF DELINQUENCY FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; ' AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA AS FOLLOWS: Section 1. Chapter 11 of the Code of Ordinances of the Village relating to "Licenses" is hereby amended at Section 11-25 to read as follows: "Sec. 11-25. Unlawful to engage in trade or business without license or with license on false statements; delinquency fees. It shall be unlawful for any person to engage in any trade, business, profession, or occupation within the Village without a license or upon a license issued upon false statements made by any person, or in his/her behalf. All licenses shall be sold by the Village beginning September 1 of each year and shall be due and payable on October 1 of each year and shall expire on September 30 of the succeeding year. Licenses not renewed by November 1 shall be considered delinquent and shall be subject to a delinquency penalty of ten (10) percent for the month of November plus an additional five (5) percent penalty for each month of the delinquency thereafter until paid; provided, however, that the total delinquency penalty shall not exceed twenty- five (25) percent of the occupational license fee for the delinquent establishment. Any person engaging in or managing any business, occupation, or profession without first obtaining a local occupational license, if required, hereunder shall be subject to a penalty of twenty-five (25) percent of the license determined to be due in addition to any other penalty provided by law or this Code. " Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end, the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 4. This Ordinance shall take effect immediately upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember who moved its adoption. The Ordinance was seconded by Councilmember , and upon being put to a vote, the vote was as follows: - 2 - FOR ADOPTION AGAINST ADOPTION The Mayor thereupon declared the Ordinance duly passed and adopted this day of , 1989.
