ZONING BOARD OF ADJUSTMENT
PUBLIC HEARING - MINUTES
JUNE 19, 1989
I. The Zoning Board of Adjustment held a regularly scheduled
Public Hearing at the Village Hall, 357 Tequesta Drive,
Tequesta, Florida, on Monday, June 19, 1989. The meeting
was called to order at 7:30 P.M. by Chairman William
Kirkland and a roll call was taken. Board Members present
were: Jerre Reddecliff, Vice Chairman, James Van Wagner,
WIlliam Kirkland, Chairman, Alfred Demott, Alternate, and
Kenneth Northamer, Alternate. Also present were Scott Hawkins,
Alternate Village Attorney and Scott Ladd, Clerk of the Board.
II. APPROVAL OF AGENDA
A)
Chairman William Kirkland requested that " Report of
Chairman and Members of the Board " be added to the agenda
as item IV.
No Board objections were received.
III. APPROVAL OF PREVIOUS MEETING MINUTES
Board Member Jerre Reddecliff moved, seconded by Alternate
Kenneth Northamer, " to approve the Zoning Board of Adjustment
Public Hearing Minutes of the Meeting held May 15, 1989. "
The vote on the motion was:
Jerre Reddecliff - for
James Van Wagner - for
William Kirkland - for
Alfred DeMott - for
Kenneth Northamer - for
IV. REPORT OF CHAIRMAN AND MEMBERS OF THE BOARD
A)
Chairman William Kirkland stated that he has recently
received some complaints concerning residents installing
boat lifts to existing docks, which per an amendment, was
interpreted to be an extension of the existing dock.
Chairman Kirkland further noted that navigational problems
have arisen due to the 85 foot canals, and in researching
this matter found that provisions dealing with boat lifts
and mooring devices were omitted in the Comprehensive Zoning
Ordinance.

Scott Ladd, Building Official, read a letter from Tim Goldsbury
of Country Club Point Property Owners Association dated June 19, 1989
in reference to Uniform Waterway Control .
A copy of the letter is attached to and made a part of these minutes
for informational purposes.
Alternate Kenneth Northamer moved, seconded by Alternate Alfred
DeMott, " That Mr. Goldsbury's letter from Country Club Point
Property Owners Association dated June 19, 1989 be introduced
as part of the minutes of this meeting and further request -that
the Building Official not issue any permits for these boat lifts
and mooring polls on canals 85 feet or under." The vote on the
motion was:

Chairman Kirkland, referencing page 128 of the Comprehensive
Zoning Ordinance, noted that the graphic of the dock shows the
dock angling off into another persons property. Chairman Kirkland
further requested that this graphic be revised.
Board Member James Van Wagner moved, seconded by Alternate Kenneth
Northamer, " that the graphic on page 128 of the Comprehensive
Zoning Ordinance adopted August 25, 1987 needs revision to
accurately portray the language of the law." The vote on the
motion was:

Chairman Kirkland indicated that form letters have been received
from the State Department of Natural Resources stating that they
have approved docks of varing lengths. Chairman Kirkland requested
that a meeting be organized by Scott Ladd with staff and a State
official to determine if these letters are requiring our man-
datory approval.

Scott Hawkins, Alternate Village Attorney, encouraged such a
meeting-to both determine what the state is requiring and to
bring the Village's dock ordinance wording into accordance with
the current .Btate Legislation.
Board Member Jerre Reddecliff moved, seconded by Board Member
James Van Wagner, " to set up a meeting with Village Attorney Hawkins,
Scott Ladd, Chairman and Board Members of the Board of AdjustmEnts,
Mr. Keirn of the State Department of Natural Resources, and a dock
contractor. " The vote on the motion was:

V. NEW BUSINESS
Scott Ladd stated that an application was received from R. Bruce
Wayne, owner of Lot 9, Block 27, Jupiter in the Pines Section "B",
located at 367 Seabrook Road, requesting a variance to the terms
of the Official Comprehensive Zoning Ordinance of the Village of
Tequesta, Ordinance No. 355, as amended, Section X, Supplemental
Regulations, Subsection (A) , General Provisions, Paragraph (8) (a) ,
Floor Elevation Above Sea Level, to allow the conversion of an
existing carport with a finish floor elevation of 7.97 ' (feet) (MSL)
into additional living area in lieu of minimun finish first floor
elevation of 8.5' (feet) (MSL) as required by the Zoning Ordinance.
Chairman Kirkland asked if the application had been publicized
and if the Village received any letters for or against the
application.
Scott Ladd stated that the application was publicized and that no
.letters were received concerning the variance request.
Mr. R. Bruce Wayne stated that his request for a variance to the
Zoning Ordinance was made in order that he might enclose the exist-
ing carport to increase the square footage of living space in
his home by approximately 200 square feet to accomodate his family
of four. Mr. Wayne further -stated that he is unable to build onto
the house in. the front; back or sides. Mr. Wayne passed out
polaroid photos of the carport to the Board Members.

Board Member Jerre Reddecliff moved, seconded by Alternate Kenneth
Northamer to approve the variance to allow the conversion of an
existing carport with a finish floor elevation of 7.97 ' (feet)( MSL)
into additional living area in lieu of minumum finish first floor
elevation of 8.5 ' (feet) (MSL) as required by the Zoning Ordinance
subject to submittal to the Village of Tequesta, from the applicant,
a letter of indemnity with regard to the finish floor elevation
variance, in a form acceptable to the Village Attorney, and that
all proposed construction must meet the various other codes and
requirements of the Village of Tequesta. " The vote on the motion
was:

Board Member Van Wagner stated that he opposed the variance request
because it is going against the Village Ordinances which were
originally made to protect both the homeowner and community
from flood problems.

TO: The Zoning Board of Adjustments
FROM: Tim Goldsbury
SUBJECT: Uniform Waterway Control
The installation of boat lifts and mooring pilings outboard
of piers and docks on wide waterways may not create navigational
problems. Such installations on waterways or canals 85' or less
in width create a navigational hazard.
Accordingly, the Building Official is requested not to grant
permits for such installations on these narrow waterways.
The provisions dealing with mooring devices have been omitted
in the Comprehensive Zoning Ordinance dated August 25, 1987. Thus,
it would appear that the Building Official has the authority to
make this interpretation without the necessity of a formal amendment
to the Zoning Ordinance.
