VILLAGE OF TEQUESTA
SPECIAL VILLAGE COUNCIL MEETING MINUTES
JULY 6, 1989
I . The Tequesta Village Council held a special Village Council Meeting
at the Village Hall , 357 Tequesta Drive,- Tequesta, Florida, on
Thursday, July 6 , 1989 . The meeting was called to order at 9 :00
A.M. by Mayor Joseph N. Capretta. A roll was taken by the
Recording Secretary. Councilmembers present were: William E.
Burckart; Ron T. Mackail ; Earl L. Collings ; Vice-Mayor Edward C.
Howell , and Mayor Joseph N. Capretta. Village Officials present
were: Thomas G. Bradford, Village Manager; John C. Randolph,
Esquire, Village Attorney; Wendy K. Harrison, Administrative
Assistant to the Village Manager; Department Heads and Bill C.
Kascavelis, Finance Director.
II . Councilmember Burckart gave the Invocation and led those in
attendance to the Pledge of Allegiance to the American Flag.
III . ORDINANCE NO. 376 - SECOND AND FINAL READING - CREATING A TEQUESTA
CODE ENFORCEMENT BOARD
Attorney Randolph gave the second and final reading of Ordinance
No . 376 . Mayor Capretta stated the purpose of the meeting was to
consider this second reading. Attorney Randolph reviewed two minor
changes, not of a substantial -nature. Those changes were: Page 3,
Section 8 . , paragraph (D) , last line, add "in order" , to read "vote
in order for the action to be official . " At the bottom of that
same page, second line of second paragraph under Section 9 . , change
" ( 2 ) years" to " ( 5) years. "
Mayor Capretta asked Attorney Randolph if there was any issue about
the $250. 00 fine vs . $500 . 00 which had been discussed previously.
Attorney Randolph explained the statute allows for $250 .00 per day
for municipal Code Enforcement Boards . The $500.00 figure is what
is allowed in the County Court system.

Mayor Capretta reminded the Council of Councilmember Collings'
previous statement of support of the Ordinance which was dependent
upon two issues : 1 ) That a member of the business community is
solicited to be on the Code Enforcement Board; and 2 ) That members
from two of the local Homeowners Associations are solicited.
Member Collings suggested that each member of the Village Council
recommend someone from each of their Homeowners ' Associations to
Village Manager Bradford. Mayor Capretta asked Village Manager
Bradford if anything had been done to solicit such support.
Mayor Capretta mentioned he had met with the Chamber of Commerce
since some of its representatives had reservations about a Code
Enforcement Board. During his conversations with the Chamber of
Commerce, Mayor Capretta suggested to those who were concerned that
they volunteer to serve on the Code Enforcement Board -- yet to
date, he had not heard from anyone.
Councilmember Collings inquired as to the effective date of
enactment of the Code Enforcement Board. Village Manager Bradford
answered he felt it probably would take at least 60 days, since
further applications are to be received, followed by formal
appointment and orientation, and a meeting with the seven members,
the Code Enforcement Officer and the Clerk to the Code Enforcement
Board is anticipated before the board is fully activated.
Member Collings inquired as to the requirements/conditions for
alternates. Attorney Randolph explained the Ordinance does not
address alternates -- only seven members .
Member Collings moved to adopt on second reading Ordinance No. 376,
with Attorney Randolph' s recommended changes . Member Burckart
seconded the motion. The vote was:
William E. Burckart - for
Ron T. Mackail - for
Joseph N. Capretta - for
Edward C. Howell - for
Earl L. Collings - for
the motion therefore passed and the Ordinance was adopted.
Vice-Mayor Howell commended the Council for the way they handled
this very controversial issue of a Code Enforcement Board.

IV. OTHER BUSINESS
Mayor Capretta stated he and Member Burckart had met and conferred
with three consulting firms regarding Public Safety and found two
to be outstanding . One of those two was recommended to do a Public
Safety Study for the Village of Tequesta. Mayor Capretta' s concern
was that Tequesta police should receive some assurance of job
security during this public safety concept study and hoped this
could be discussed at the July 13 Village Council Meeting.
V. ADJOURNMENT
There being no other matters before the Council , the meeting was
adjourned at 9 : 20 A.M.
