We have informed the members of the Finance and Administration Committee of our desire to increase the fees by the said amount. Please review the 'proposed ordinance for legal form and sufficiency. Ladd, Building Official j DATE: June 16, 1989 SUBJECT: Proposed increase in building permit fees., Tom, attached are nine ( 9) copies of a proposed ordinance changing the building permit fee schedule [ Sec. 6- 142. ( a) ] by increasing the permit fee as a percentage of the valuation of the proposed construction or work, by an amount equal to one-half of one percent. As you are aware, we currently collect a permit fee of one percent ( 1. 0%) of the value of the proposed construction or work. This proposed increase would require a permit fee of one & one-half percent ( 1. 5%) . This action would bring us closer to the two percent ( 2. 0%) that Palm Beach County and several other municipal agencies are currently collecting. Palm Beach County and the agencies collecting two percent ( 2. 0%) utilize a single permit system wherein, for example, a building permit for a proposed new single-family dwelling would be paid for at two percent ( 2. 0%) of the valuation of the proposed construction of work by the prime contractor ( general, building, or residential contractor) . This two percent ( 2. 0%) permit would include the permit fees for all subsequent subcontractors; plumbing, electrical, A/C, roofing, etc. , who might perform work at this single-family dwelling. Tequesta' s fee system requires that the prime contractor would pay the permit fee, at for example, one & one half percent ( 1. 5%) and that all subsequent subcontractors also pay a fee for the work they propose to perform. This format gives us better control over the subcontractors and would generate total permit fees for our single-family dwelling example that will be approximately the same amount that Palm Beach County and the other two percent ( 2. 0%) single permit fee agencies are collecting. Page 2 June 16, 1989 Psychologically, a fee of one & one half percent ( 1. 5%) is easier to accept if you are a contractor than a fee of two percent ( 2. 0%) , and the fact that a prime contractor' s subcontractors must, in turn, pay their own permit fees for the portion of the work they perform is not really a burden or an unreasonable request. Please review the proposed ordinance and place it on an upcoming Council agenda for first reading and discussion. SDL: i ms attch. ipProvoli 1 ORDINANCE NO. , U° AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER VI OF THE CODE OF THE VILLAGE PROVIDING FOR THE PAYMENT OF CERTAIN FEES ENUMERATED THEREIN TO THE BUILDING OFFICIAL; BY AMENDING SECTION 6-142( a) , THE FEES RELATING TO BUILDINGS, STRUCTURES OR ALTERATIONS REQUIRING A PERMIT; PROVIDING FO SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE 0 TEQUESTA. FLORIDA, as follows: Section 1. Chapter VI of the Code of Ordinances of the Village of Tequesta is hereby amended at Section 6-142( a) to read as follows: ( a) Building Permits generally: Valuation Amount of Fee Under $500. $ 25. 00 500. - 999. 30. 00 1,000. - ' 1,999. 35. 00 2.000. - 2,999. 40. 00 3.000. - 3,999. 45. 00 4.000. - 4.999. 50. 00 5,000. - 5.999. 55. 00 6,000. AND ABOVE FEE EQUAL TO ONE & ONE HALF PERCENT ( . 015%) OF THE VALUATION OF THE PROPOSED CONSTRUCTION. Section 2. Severability. If any section, part of - section, paragraph, sentence, clause, phrase or word of thi= Ordinance is for any ' reason held or declared to b= unconstitutional, inoperative or void, such holdings o % invalidity shall not affect the remaining portions of thi= Ordinance, and it shall be construed to have been th= legislative intent to pass this Ordinance without suc unconstitutional, invalid or inoperative part therein, and th= remainder of this Ordinance, after the exclusion of such part o• parts, shall be deemed to be held valid as if such part or part= had not been included therein, or if this Ordinance or any of the provisions thereof shall be held inapplicable to any person, group of persons, property, kind of property, circumstances o• set of circumstances, such holdings shall not affect th= applicability thereof to any other person, property o• circumstances. Section 3. Codification. This Ordinance shall be codifie• and made a part of the official Code of Ordinances of th= Village of Tequesta, Florida. Section 4. Effective Date..
