AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, PROVIDING
j-1 FOR AN AMENDMENT TO CHAPTER . 7 OF THE CODE OF
ORDINANCES BY PROVIDING A NEW PARAGRAPH AT SECTION 7-
4(a), PROVIDING THAT A MEMORANDUM FROM THE CHAIRMAN
OF THE COMMUNITY APPEARANCE BOARD TO THE VILLAGE
COUNCIL SHALL BE REQUIRED WITH EACH SITE PLAN REVIEW
APPLICATION CONSIDERED BY THE VILLAGE COUNCIL;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Chapter 7 of the Code of Ordinances of the Village
of Tequesta is hereby amended by providing an additional
paragraph to Section 7-4(a), to read as follows:
"The Chairman, or Vice-Chairman in the absence of the Chairman,
shall be required to provide a Memorandum to the Village
Council concerning all site plan review applications reviewed
by the Community Appearance Board submitted to the Village
Council for review. The Memorandum shall reference matters of
special concern, if any, as expressed by the the majority of
the members of the Community Appearance Board. Matters of
particular interest to be addressed within the required
Memorandum are the criteria and supplemental criteria utilized
by the Community Appearance Board when reviewing plans and
specifications submitted to the Board. The Memorandum shall be
submitted to the Village for inclusion with any site plan
review application before the Village Council or with an appeal
to the Council by any person aggrieved by a decision of the
Board. "
Section 2. If any provision of this Ordinance or the
application thereof is held invalid, such invalidity shall not
affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or
applications and to this end, the provisions of this Ordinance
are hereby declared severable.
Section 3. This Ordinance shall be codified and made a part
of the official Code of Ordinances of the Village of Tequesta.
Section 4. This Ordinance shall take effect immediately upon
its passage and approval, as provided by law.
