Bradford, Village Manager Village of Tequesta Post Office Box 3273 Tequesta, Florida 33469-0273 Dear Tom: Please find enclosed an amended ordinance relating to the change in water rates. You will note that I have included the words "monthly" in Section I so as to make it clear that this is a monthly charge. Additionally, I have included language which attempts to address the problem of prorating units which are included on a master meter. I hope that language accomplishes .its intended purpose. Perhaps Tom Hall will have a suggestion in regard to this language. I am copying him with this ordinance in the event he has any suggestions. Very truly,,,,urs, AP John C. Randolph cc Tom Hall ORDINANCE NO. 3g AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY FLORIDA, AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES: "WATER" ARTICLE I AT SECTIONS 18-3 (b) RELATING TO WATER RATES AND CHARGES, SO AS TO PROVIDE FOR A STEPPED INCREASE IN RATES AND SECTION 18-3(f) SO AS TO INCREASE THE CAPITAL IMPROVEMENT CHARGE FOR NEW CONNECTIONS ON JUPITER ISLAND TO $2 , 310 . 00; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: SECTION I Chapter 18 of the Code of Ordinances of the Village relating to "Water" is hereby amended at Sections 18-3 (b) and 18-3(f ) to read as follows: " (b) Quantity Rate. Applicable to all quantities of water shown by meter readings to have been delivered: (1 ) Commercial Accounts - Monthly: $1.05 for each 1, 000 gallons or fraction thereof. (2 ) Residential Accounts - Monthly: $1.05 for each 1,000 gallons or fraction thereof up to $30, 000 gallons delivered; $2.80 for each 1,000 gallons or fraction thereof from 30,001 to 50,000 gallons delivered; $4 .80 for each 1,000 gallons or fraction thereof for all quantities delivered above 50,000 gallons. In the event there is a master meter measuring quantities of water for two or more residential units, the gallons measured and charged pursuant to the terms of this section shall be prorated by dividing the total gallons metered by the number of units included on the master meter. (f ) Capital Improvement Charge. Each new connection to the water system after the effective date of this sub-section [December 1 , 1976 ] shall pay a capital improvement charge of four hundred dollars ( $400. 00 ) for each 5/8-inch by 3/4-inch meter or equivalent thereof at the time of the application for a new connection. Such payments shall go into a capital improvement fund which shall be a separate fund to be used for capital improvements to the water system or for payment of debt service on the water revenue certificates, series 1976 , or subsequent issues. In addition to the capital improvement charge set forth herein, each new connection to the water system located on that geographic area within the system known as Jupiter Island, shall pay a capital improvement charge of two thousand three hundred ten dollars ( $2, 310 . 00 ) for each dwelling unit, at the time of the application for a new connection. Such payments shall go into a capital improvement fund, which shall be a separate fund to be used for capital improvements to the water system related to the improvements for the users on Jupiter Island. SECTION II If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance are hereby declared severable. SECTION III This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. SECTION IV This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
