The Smoke Inn is interested in purchasing the Bank of America (BOA) building located at 150
Tequesta Drive in Tequesta, Florida. The property is 1.4 acres in size and is located within the
Village Mixed Uses Zoning District. The BOA Building is approximately 6,100 and was
constructed in 2004. The bank has discontinued operations at this location. The building remains
dark and has been vacant for over a year.
The Smoke Inn is a retail cigar sales and smoking lounge currently located in the Gallery Square
Shoppes. They are well known throughout south Florida as being the premier source for quality
cigars and for having Florida's largest walk-in humidors. The Smoke Inn has been located within
the Village of Tequesta for over 25 years and has an avid following of cigar connoisseurs. They
desire to expand in a location where they can expand their offerings to include fine bourbons,
whiskey, and similar beverages. Additional space and the ability to serve fine drinks will enhance
the customer experience.
APPLICANT'S ISSUE
The Code of Ordinances currently does not allow establishments that serve alcohol within the
Mixed -Use District. While there are restaurants that serve alcoholic beverages within the district
it has been determined by Village staff that the sale of alcoholic beverages by the glass as desired
by the Smoke Inn would be considered a Bar / Lounge. The C-3 zoning district is the only location
where Bar / Lounge use is permitted within the Village. The C-3 zoning district is limited to a very
small geographic area located along Cypress Drive.
REQUESTS
The applicant is seeking consideration from the Village Council for the following:
1. A Zoning Text Amendment (ZTA) to allow "Bar / Lounge", ancillary to retail cigar lounge,
as a special exception (SE) use within the Village Mixed -Use zoning district.

In summary, it is applicant's desire to keep the Smoke Inn in the Village of Tequesta. The applicant
commits to working with the Village to develop appropriate code language to support the proposed
use while protecting public health, safety and welfare.
