Harrison, Adminis ra ive Assistant to the Village Manager DATE: February 17, 1989 SUBJECT: Proposal for Engineering Services for Tequesta Drive Streetscape Please find attached ,a Proposal for engineering design services for the above-referenced project. This project includes plans for street trees, median plantings, the entrance wall sign: plantings, irrigation plans and specifications, and construction plans and specifications for the wall signs. This contract also includes electrical service plans and specifications for the irrigation system and sign lighting. Attached for your reference are the preliminary median and entrance wall sign designs approved by the Community Appearance Board and Planning Commission. This project was approved by the Council during the budget process, and $8, 200 is allocated in the FY 89 Capital Improvement Program for the design. As you will notice, the total fees in this contract are $10,000, which is $1, 800 more than anticipated. Enclosed for your information is a letter from Gee & Jenson explaining the variance. We are satisfied with this Proposal, in that it was the result of much negotiation between the Village and the Planner. I believe I speak for Mr. Bradford in saying that the Village Administration recommends that you approve this Proposal. There is also a timing consideration, as we wish to include the irrigation and electrical specifications in the bid documents for the Tequesta Drive Improvement Project, and we expect these bid documents to be prepared in March. The end product of this contract will be presented to the Village Council or appropriate subcommittee thereof for final approval. WKH/mk Attachments (4) cc: Thomas G. Village of Tequesta 357 Tequesta Drive Tequesta, FL 33458 Attn: Mr. Thomas Bradford, Village Manager Re: Tequesta Drive Streetscape Gentlemen: We are pleased to submit the following proposal for professional services in connection with landscape and entrance sign wall design for Tequesta Drive. Gee & Jenson Engineers-Architects-Planners, Inc. , hereinafter referred to as the Planner, proposes to furnish professional services for The Village of Tequesta, hereinafter referred to as the Client of the scope outlined below for the fees stipulated herein. Scope of Services The Planner will perform the following: 1. Prepare landscape plans and specifications for Tequesta Drive. Plan will include street trees, median plantings and entrance sign wall plantings. Project limits will be within the Tequesta Drive right-of-way from U.S. Highway One to Fiesta Avenue. 2 . Prepare irrigation distribution plans and specifications for proposed landscaping. 3 . Prepare sign wall and construction plans and specifications for two (2) identical illuminated sign walls located at Tequesta Drive and U.S. Highway One. 4. Prepare electrical service plans and specifications for irrigation system and sign wall lighting. Designate in writing a person to act as the Client's representative with respect to the services to be performed under this Agreement. Such person shall have complete authority to transmit instructions, receive information, interpret and define the Client's policies and decisions with respect to materials, equipment, elements and systems pertinent to the Planner's services. Please note special conditions for invoicing items necessary to perform the services, that are ordered or purchased by the Planner which should be furnished by the Client under section "Fees to be Paid". Time of Performance Items 1 through 4 of the Scope of Services will be completed on or before March 15, 1989, or in conjunction with the construction documents for Tequesta Drive, whichever is sooner. Fees to be Paid For Items 1 through 4 of the Scope of Services the Planner shall be paid a lump sum fee of $10, 000. Invoices for services rendered are prepared monthly and are due and payable within twenty-one (21) days from date of invoice. • Payments which are not received within sixty (60) calendar days from the date of invoice will be considered sufficient cause for Planner to discontinue performing and providing services until payment in full is received. If Planner is required to take action to collect past due invoices the Client will pay all legal fees and costs. Should a court decide upon payment of these invoices the prevailing party shall receive payment of the Attorney's fees. GEE&JENSON Engineers,Architects,Planners,Inc. Village of Tequesta Attn: Mr. Thomas Bradford, Village Manager February 9, 1989 - Page 3 This contract shall be governed by the laws of the State of Florida, and the appropriate venue for any actions arising out of the agreement would be West Palm Beach, Florida. If there are items that must be sublet, confirmed, certified or • updated, the Planner shall order the work with the Client's approval, and the subcontractor shall bill the Client directly. The Client must make payments in accordance with the terms on the invoice in order not to stop the work. If the Planner is directed by the Client to handle the subcontract for the Client there will be a fifteen (15) percent charge for handling. The invoice must be paid within ten (10) days. Termination This Agreement may be terminated by either party by giving thirty (30) days advance written notice. The Planner shall be paid for services rendered to the date of termination on the basis of a reasonable estimate of the portion of services completed prior to termination and shall be paid for all reasonable expenses resulting from such termination and for any unpaid reimbursable expenses. One signed copy of this proposal returned to the Planner will serve as an Agreement between the two parties and as Notice to Proceed. This contract will be binding on the parties hereto and the parties' successors and assigns. Should this proposal not be accepted within a period of thirty (30) days from the above date, it shall become null and void. Village of Tequesta 357 Tequesta Drive Tequesta, Florida 33458 Attn: Mr. Thomas Bradford, Village Manager Re: Tequesta Drive Streetscape Dear Tom: Wendy Harrison asked me to provide you with a written justification for the variance between the amount you had budgeted for the above referenced project ($8,200 hourly charges plus reimbursable expenses) and the final contract amount ($10 ,000 lump sum, including expenses) . The original estimate was done quickly last August before we were able to completely detail the scope of services, the amount of construction involved in the irrigation system and the electrical system to the sign wall along Tequesta Drive., Subsequent to our verbal estimate to you in August, we internally generated a written scope and fee for the services and discovered the verbal quote did not include enough to design an irrigation system ($500 increase) or the electrical system ($600) . Also, the original estimate did not include reimbursables which we estimate to be $700. The sum of these two items totals $1800 which covers the noted difference.
