plat and the protective covenants for the above subject
project. Please place this item on the agenda of the
January 26, 1989 Council meeting agenda for review by the

NOTICE OF MEETING
PRELIMINARY AND FINAL PLAT REVIEW
"CYPRESS RIDGE SUBDIVISION"
The Village Council of the Village of Tequesta will review the
final plat of the above proposed Subdivision at its regularly scheduled
Council meeting on Thursday, January 26, 1989 beginning at 5: 30 P. M.
The proposed Subdivision does not meet all the minimum
requirements as set forth in the Comprehensive Zoning Code of the Village
of Tequesta, Ordinance No. 355, as amended. Specifically, lots 38 thru 42
do not meet the minimum required lot width. The zoning code for R-2
district requires a minimum lot width of 80' ( feet) . The proposed final
plat indicates lot widths of 74' ( feet) for lots 38 - 41 and 75' 02' ( feet)
for lot 42.
Because some of the lots do not meet the minimum requirements, an
application was submitted to the Zoning Board of Adjustment for a
variance. The Zoning Board met on December 19, 1988, at which time the
Village Attorney informed the Board that in his opinion the Board could
not legally act upon a request for a variance on lots that had not yet
been platted, but that the Board could offer an advisory opinion with
regard to the variance request. The Zoning Board of Adjustment approved
the application as an advisory opinion as follows: if the specific
variances presented by the applicant in regard to the petition had been
brought by the applicant, that the Board of Adjustment would have approved
such variances.
Appendix B - Subdivision Regulations of the Village of Tequesta,
Article VI. Variances, Section 1. states that "Where the Council finds
that extraordinary hardships may result from strict compliance with these
regulations, it may recommend the variance of the regulations so that
substantial justice may be done and the public interest secured; provided
that such variation will not have the effect of nullifying the intent and
purpose of a Comprehensive Development Plan, the Zoning Ordinance or these
regulations, and such variance is issued by the Village Council. "
"If a person decides to appeal any decision made by this Council
with respect to any matter considered at this meeting or hearing, he/she
will need a record of the proceedings, and that, for such, purpose, he/she
may need to insure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the appeal is
to be based. "
