SUBJECT: Consideration of Ordinances to Facilitate the
Objectives of the Village Council Relative to Utility
Operations and Facilities
DATE: January 15, 1988
Two recent events regarding this subject are:
1 ) During the Summer of 1987, at the LOCAL GOVERNMENT
PLANNING AGENCY (Village Council ) Public Hearings
conducted to receive public input relative to the
upgrade of the Comprehensive Plan, the Village Council
indicated to Eugene Caputo that it was the Village
Council 's desire that it be the goal of the Village to
see that all above-ground utility lines ultimately be
placed underground and this goal be so stated at the
appropriate location within the Comprehensive Plan.
2 ) The ENCON installation of the IQ Water System along
Country Club Drive indicated the need for closer
coordination between various utilities and local
government.
Possible solutions to effectuate the above stated objectives
of the Village Council are as follows:
1 ) Create an ordinance whereby at any time when a utility
company having overhead lines wishes to repair or
replace the same, that section or segment shall be
placed underground pursuant to the direction of the
Comprehension Plan of the Village of Tequesta.
2) Create an ordinance whereby a right-of-way/easement
permit program is implemented within the Village of
Tequesta. Permits issued under the program would be
free of charge. Utilities and other companies wishing
to work within the rights-of-way and easements within
the corporate, limits of the Village would be required
to first pull a permit. The application for the
permit would require an indication of the type of work
to be done. Utility companies wishing to repair or
replace section or segments of overhead utility lines
would not be issued . a permit. To engage in said
activities without a permit would be punishable by
law.

The benefits to be derived from the aforementioned
ordinances are as follows:
1 ) A mechanism for informing the Village of utility
company activity within the corporate limits of
Tequesta.
2 ) Systematic removal of overhead utility lines to a
location underground.
3 ) A mechanism to hopefully eliminate unauthorized
activity within the rights-of way of the Village of
Tequesta and to also eliminate unauthorized cuts
within the pavement that we have experienced in the
Village.
4) Ultimately, every parcel of land will be catalogued
within a computer capable of graphically displaying
the parcel of land indicating the dimensions of the
various improvements thereon, as well as indicating
the location of utilities and appurtenances upon the
said property. The implementation of a right-of-way
permit program would create the framework for
gathering the data necessary for this forthcoming
computerized land management system. For example, a
person wishing to place a sprinkler system within the
right-of-way and easements abutting his private
property under such a program would pull the permit to
do the same and the Village would have a record of the
exact location of the sprinkler system for our
computer system. The value of such information when
planning Public Works projects is immeasurable.
Village Council direction relative to these suggestions is
requested. Consideration of this memorandum will be placed upon
the Village Council agenda for January 26, 1988, for discussion
and consideration.
