Dear Tom:
I have reviewed the appraisal that you forwarded me as
well as other documents concerning the proposed condemnation
of the above property. You have asked me to estimate the
cost of proceeding to acquire this property through eminent
domain.
As you are aware, in condemnation, the condemning authority,
in this case, the Village of Tequesta, is required to pay the
attorney' s fees and costs of the property owner as well as the
amount of full compensation. Accordingly, I will try and
provide you a very rough guess as to what these costs might
be.
It would be my expectation that filing and completing a
condemnation suit would require in the range of 25-40 hours
of this firm' s legal time which would be compensated at the
hourly rate for which our firm provides the Village with legal
services. The appraisal prepared by R.C. Bennett & Associates
is dated September 20, 1986 and would have to be updated and
someone from Mr. Bennett's office would be required to testify
at a hearing on an order of taking and, at trial, if the case
were not settled. These costs would probably range somewhere
from $3,000-$5,000 assuming the testimony was required twice.
However, just an updated appraisal should not be more than
several hundred dollars. In anticipation that the land, owner' s
attorney would expend the same number of hours as the Village' s
attorney, an attorney's fee for the land owner' s attorney would
range from $3,000-$5,000.

I have reviewed the correspondence and note that the
property owner is asking for twice the appraised value. It
would appear to me that it would be a favorable compromise
and shorten the time frame considerably if the Village could
acquire this property without going to litigation at a price
not to exceed $24,000.00.
