Collings, Councilmember FROM: Thomas G. Bradford, Village Manager --� SUBJECT: Review of Community Appearance Board Ordinance DATE: December 14, 1987 At the Village Council meeting of November 17, 1987 you requested that the Village Manager and/or the Village Attorney review the Community Appearance Board Ordinance in order to ascertain the appropriateness of providing language that would guarantee that all future commercial construction be in harmony or compatible with the surrounding architecture. In reviewing the Community Appearance Board Ordinance I discovered Section 7- 6, (a) , ( 1) and (2) which are supplemental criteria and procedural rules of the Community Appearance Board. Section 7-6, (a) , (1 ), states that "buildings or structures which are a part of a present or future group or complex shall have a unity of character and design. . . " This would appear to- apply to shopping centers and be the legal basis for the Board' s recent denial of the Vic's Hardware application for changing their facade. Section 7-6, (a), (2) states that "buildings or structures located along strips of land or on single sites and not a part of a unified multi-building complex shall strive to achieve visual harmony with the surroundings. If they are built in undeveloped areas, the three (3 ) primary requirements shall be met- express honest design construction, show proper design concepts, and be appropriate to the Village. " This would seem to apply to free standing buildings and be the legal basis for insuring that proposed architecture be appropriate and in harmony with the Village. Therefore, if I understood your request of November 17 correctly it would appear that language currently exists which will provide the Community Appearance Board with the ability to deny architecture which is not in keeping with that desired within Tequesta. Should you agree with me, then perhaps it would be appropriate to distribute copies of the Community Appearance Board Ordinance to each member of the Board to insure that .they are familiar with their powers and duties.
