The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Special Magistrate Hearing held on the 91 day of May 2023,
and based on the evidence and testimony presented, enters an Order Assessing Fine. The
following Findings of Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
The Respondents are the owners of the above -described property.
2. The Respondents were present at the hearing; there was a finding
of proper notice.
Code Officer Latoya Thompson provided testimony and evidence of the violation,
as contained in the Village's evidentiary case file which was accepted into
evidence without objection.

4. By the "Order Finding Violation" dated March 14", 2023, the Special Magistrate
ordered the Respondents to comply with Chapter 14, Article II, Section 14-31,
Chapter 14, Article 1, Section 14-6, of the Code of Ordinances of the Village of
Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition) by
March 2411, 2023.
5. Based upon the evidence, pictures, and testimony presented at the hearing on
May 9th, 2023, the property has obtained compliance with sections 14-31, 14-6,
and 105.1 of the Tequesta Code of Ordinances and Florida Building Code within
the time set by the Special Magistrate.
CONCLUSIONS OF LAW
The property is now in compliance with Sections 14-31, 14-6, and 105.1 of the Code of
Ordinances of the Village of Tequesta and the Florida Building Code (Seventh Edition).
ORDER
The Respondents are hereby assessed three hundred eighty-eight dollars and thirty cents
($388.30) for administrative costs incurred by the Village for the March 14', 2023, and May 9`h,
2023, special magistrate code hearings.
Should you violate the same Section of the Code again, you may be subject to a
fine of up to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the
Code Inspector is not required to give a reasonable time to correct the repeat violation and the
case may be presented to the Special Magistrate even if the repeat violation has been corrected
prior to the Special Magistrate hearing.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondents to contact the Code Compliance Division at (561) 768-0519 to request a
reinspection of the property.
